RESOLUTION AMENDING RESOLUTION R-24-1227 AUTHORIZING AN AWARD OF CONTRACT TO AURORA ENVIRONMENTAL, INC., FOR THE COUNTY’S UNDERGROUND STORAGE TANKS (UST) AND ABOVE GROUND STORAGE TANKS (AST) MONTHLY INSPECTIONS AND ANNUAL TESTING FOR THE YEAR 2025, PER BID SB-25-004 PURSUANT TO N.J.S.A. 40A: 11-4, ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40A: 11-4, the Board approved R-24-1227, dated December 10, 2024, authorizing an award of a contract, under Resolution No. R-24-1227, to Aurora Environmental, Inc., for monthly inspections and annual testing for the year 2025 in an amount not to exceed thirty-seven thousand one hundred twenty-eight dollars ($37,128.00); and
WHEREAS, on October 3, 2024, the Purchasing Agent issued SB-25-004, On-Call Services for Underground Storage Tanks (UST) and Above Ground Storage Tanks (AST) (hereafter “SB-25-004”) seeking sealed proposals from qualified bidders for On-Call Services for Underground Storage Tanks and Above Ground Storage Tanks; and
WHEREAS, on November 18, 2024, the Board passed Resolution No. R-24-1056, establishing unit prices and qualifying respondents to be used on an as needed basis under SB-25-004 for a period of two years, beginning January 1, 2025, through December 31, 2026, with Aurora Environmental and T. Slack Environmental offering their unit prices to the County; and
WHEREAS, funds are available in Account No. 5-01-31-220-001-219 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the November 26, 2024, meeting of the Public Works Committee and was recommended to the Board for approval; and
WHEREAS, Resolution No. R-24-1227 incorrectly indicated “for monthly inspections and annual testing for the year 2024” in the second to last paragraph; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40:32-7.12 that the Passaic County Board of Commissioners of the County of Passaic (“Board”) hereby amends Resolution No. R-24-1227 to instead indicate “for monthly inspections and annual testing for the year 2025” correcting the year.
LET IT BE FURTHER RESOLVED, that all other terms and conditions set forth in Resolution No. R-24-1227, to the extent not inconsistent with this Resolution, shall remain in full force and effect.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, and Director of the Board of County Commissioners are authorized to execute the contracts and take any other steps necessary to carry out the purpose of this resolution.
