RESOLUTION RATIFYING MEMORANDUM OF AGREEMENT BETWEEN THE COUNTY OF PASSAIC AND THE INTERNATIONAL BROTHERHOOD OF TEAMSTERS, LOCAL NO. 11, REPRESENTING VARIOUS PUBLIC WORKS EMPLOYEES AT THE COUNTY, FOR A PERIOD RETROACTIVE TO JANUARY 1, 2024 THROUGH DECEMBER 31, 2028 PURSUANT TO N.J.S.A. 34:13A-1, ET SEQ.

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the International Brotherhood of Teamsters, Local No. 11 (“IBT, Local No. 11”) is the designated bargaining unit for various public works employees in the County; and
WHEREAS, the County and International Brotherhood of Teamsters, Local No. 11 are members to a Collective Negotiations Agreement (“Agreement”) that expired on December 31, 2023; and
WHEREAS, the County and International Brotherhood of Teamsters, Local No. 11 negotiated various amendments to the Agreement, in good faith and in compliance with N.J.S.A. 34:13A-1, et seq.; and
WHEREAS, the County and International Brotherhood of Teamsters, Local No. 11 executed a Memorandum of Agreement (“MOA”), attached hereto and made part of this Resolution, setting forth the terms and conditions to be amended in the Agreement; and
WHEREAS, in accordance with N.J.S.A. 34:13A-1, et seq., a majority of International Brotherhood of Teamsters, Local No. 11’s membership ratified the MOA; and
WHEREAS, this matter was discussed at the December 18, 2024 Administration and Finance Committee meeting and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 34:13A-1, et seq., the Board of County Commissioners of the County of Passaic ratifies the Memorandum of Agreement between the County of Passaic and the International Brotherhood of Teamsters, Local No. 11, representing various public works employees at the County.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, County Administrator and Director of the Board are authorized to amend and execute a revised Collective Negotiations Agreement, reflecting the terms and conditions set forth in the Memorandum of Agreement.
