RESOLUTION ADJUSTING THE BID THRESHOLD FOR THE COUNTY OF PASSAIC TO $53,000 AS AUTHORIZED BY THE NEW JERSEY STATE TREASURER, AND PURSUANT TO N.J.S.A. 40A:11-3(c)

WHEREAS, pursuant to N.J.S.A. 40A:11-3(c), the Governor, in consultation with the Department of Treasury, shall, no later than March 1 of every fifth year beginning in the fifth year after the year in which P.L. 1999, c.440 takes effect, adjust the [bid] threshold amount, in direct proportion to the rise or fall of the index rate as the term is defined in section 2 of P.L. 1971, c. 198 (C.40A:11-2), and shall round the adjustment to the nearest $1,000; and
WHEREAS, furthermore, the Governor shall, no later than June 1 of every fifth year, notify each governing body of the adjustment, and the adjustment shall become effective on July 1 of the year in which it is made; and
WHEREAS, in order to raise the bid threshold as set forth under the law, the governing body is required to have appointed a qualified purchasing agent, pursuant to N.J.S.A. 40A:11-9(b); and
WHEREAS, on June 17, 2025, the Passaic County Board of County Commissioners (hereafter “Board”) passed Resolution No. R-25-0525, reappointing Sherry Arvanitakis, QPA as the County’s Purchasing Agent, for a three (3) year term commencing July 1, 2025 and terminating June 30, 2028, as prescribed under the law; and
WHEREAS, on July 1, 2025, the New Jersey Department of Community Affairs, Division of Local Government Services, issued Local Finance Notice 2025-08, which is attached to and made part of this resolution, authorizing contracting units with qualified purchasing agents, which includes the County, to increase the maximum bid threshold from forty-four thousand dollars ($44,000.00) to fifty-three thousand dollars ($53,000.00); and
WHEREAS, the County’s Purchasing Agent is recommending that to the Board that the bid threshold be increased to fifty-three thousand dollars ($53,000.00); and
WHEREAS, this matter was discussed on July 9, 2025 via email by the Administration and Finance Committee, and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-3(c), and the authorization of the New Jersey State Treasurer, that the bid threshold in the County of Passaic is raised to fifty-three thousand dollars ($53,000.00).
LET IT BE FURTHER RESOLVED, that the Purchasing Agent, County Counsel, and County Administrator are authorized to take any other steps necessary to carry out the purpose of this resolution.
