RESOLUTION REJECTING ALL BIDS RECEIVED FOR SB-26-001, AQUATIC VENUE MAINTENANCE AT CAMP HOPE, PURSUANT TO N.J.S.A. 40A:11-13.2(d)

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners for the County of Passaic (hereafter “Board”) is vested with decision-making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40:23-6.1, the Board established Camp Hope in the Township of West Milford, for the purpose of operating a summer camp for under-nourished and under-privileged children in the County whose health may benefit by it, and to advance public recreation and enhance the public health and welfare; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., for every contract awarded by the County for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold established pursuant to N.J.S.A. 40A:11-3, shall be awarded by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, on August 8, 2025 the Passaic County Purchasing Agent issued SB-26-001 Aquatic Venue Maintenance at Camp Hope seeking a state licensed pool and spa service contractor to perform maintenance services at the pool and spray park located at Camp Hope in the Township of West Milford; and
WHEREAS, on August 19, 2025, the Purchasing Agent unsealed all bids received in response to SB-26-001; and
WHEREAS, the County received one bid proposal from V. Lehmann Construction Company Inc. DBA Lehmann Pools and Spas; and
WHEREAS, pursuant to N.J.S.A. 40A:11-13.2(d), the Board may reject all bids received if the contracting unit wants to substantially revise the specifications for the goods or services; and
WHEREAS, the Director of Parks and Recreation is recommending to the Board that all bids received in response to SB-26-001 be rejected to substantially revise the specifications pursuant to 40A:11-13.2 (d.); and
WHEREAS, this matter was discussed at the September 17, 2025 meeting of the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-13.2(b), the Board of County Commissioners of the County of Passaic rejects all bids received in response to SB-26-001, Aquatic Venue Maintenance at Camp Hope, to substantially revise the specifications pursuant to 40A:11-13.2 (d.).
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, and Director of the Board of County Commissioners are authorized to execute an agreement and take any other steps necessary to carry out the purpose of this Resolution.
