RESOLUTION QUALIFYING ABDELHADI & ASSOCIATES, LLC AND AWARDING CONTRACT TO ABDELHADI & ASSOCIATES, LLC TO PROVIDE LEGAL SERVICES TO THE PASSAIC COUNTY PLANNING BOARD FOR CALENDAR YEAR 2026 AND APPROPRIATING AN AMOUNT NOT TO EXCEED $17,500.00, PURSUANT TO N.J.S.A. 40A:11-5(1).

WHEREAS, the County of Passaic (hereafter “County”) is a governmental body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners for the County of Passaic (hereafter “Board”) is vested with decision-making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-5(1), the Purchasing Agent issued RFQ-26-031, Passaic County Planning Board (hereafter “PCPB”) Outside Counsel for the Calendar Year 2026 (hereafter “RFQ-26-031”), to be hired for the period beginning January 1, 2026, through December 31, 2026, to provide legal services to the PCPB; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.4, the County’s request for qualifications is a fair and open process, specifically, the qualification for RFQ-26-031 is publicly advertised, awarded under a process that provides for public solicitation of qualifications, established the basis of an award and disclosure process documented in writing prior to any solicitation, and is publicly opened and announced when awarded; and
WHEREAS, the Evaluation and Review Committee (hereafter “ER Committee”) has found that the following vendors are qualified to perform the necessary legal services for the PCPB:
1. The Law Office of Marco Di Stefano, Esq., LLC
2. Florio Kenny Raval, L.L.P.
3. The Law Offices of Abdelhadi & Associates, LLC
4. Souder Law Group, LLP
WHEREAS, the ER Committee desires to award a contract to Abdelhadi & Associates LLC for legal services to the PCPB from January 1, 2026, through December 31, 2026 in an amount not to exceed seventeen thousand five hundred and 00/100 ($17,500.00) to provide professional services of Outside Counsel to the PCPB; and
WHEREAS, funds are available in Account No. 6-01-22-147-001-233 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent years’ County budget(s); and
WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et seq., vendor executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying the vendor is not involved in prohibited activities in Russia and Belarus, and the County confirmed vendor is not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, this matter was discussed at the September 17, 2025, meeting of the Planning and Economic Development Committee and is being recommended to the Board for approval;
NOW THEREFORE, LET IT BE RESOLVED pursuant to N.J.S.A. 40A:11-5(1), that The Law Office of Marco Di Stefano, Esq., LLC, Florio Kenny Raval, L.L.P., The Law Offices of Abdelhadi & Associates, LLC, and Souder Law Group, LLP are qualified to provide legal services for the PCPB; and
LET IT BE FURTHER RESOLVED that pursuant to N.J.S.A. 40A:11-5(1), the Board of County Commissioners for the County of Passaic (hereafter “Board”) hereby awards a contract to Abdelhadi & Associates LLC to provides legal services as Outside Counsel to the PCPB for the calendar year 2026, as recommended by the Evaluation and Review Committee, in a contracted amount not to exceed seventeen thousand five hundred and 00/100 ($17,500.00) dollars; and
LET IT BE FURTHER RESOLVED that the Clerk to the Board shall print in the official newspaper a brief notice stating the nature, duration, service, and amount of the contract to Abdelhadi & Associates LLC and maintain a copy of the Resolution on file and available for public inspection in the Office of the Clerk to the Board;
LET IT BE FURTHER RESOLVED that the Clerk to the Board, County Counsel, and the Director of the Board are authorized to execute the contracts and take any other steps necessary to carry out the purpose of this Resolution; and
