RESOLUTION AUTHORIZING AWARD OF A CONTRACT TO CABLEVISION LIGHTPATH LLC FOR PROVISION OF VOICE SERVICES, PURSUANT TO N.J.S.A. 40A:11-10

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-10, the governing bodies of two or more contracting units may provide by a joint agreement for the provision of the performance of goods and services to be used by their respective jurisdictions; and
WHEREAS, the County is a member of the Educational Service Commission of New Jersey Cooperative Contract Purchasing System, #65MCESCCPS, a joint cooperative pricing system, offering competitive pricing for various goods and services established pursuant to N.J.S.A. 40A:11-10, which awarded a contract to Cablevision Lightpath LLC for Unified Communications, Voice and Collaboration Solutions - ESCNJ 23/24-10; and
WHEREAS, the Director of Management and Information Systems is recommending that the Board award a contract to Cablevision Lightpath LLC, pursuant to ESCNJ 23/24-10 and the attached quote, for the provision of voice services at various County facilities for a three-year term, beginning on July 1, 2025 and expiring on June 30, 2028, for a total amount not to exceed two hundred fifty-six thousand thirty-four dollars and sixteen cents ($256,034.16) during such term; and
WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et seq., Cablevision Lightpath LLC executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying that it is not involved in prohibited activities in Russia and Belarus, and the County confirmed that Cablevision Lightpath LLC is not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, funds are available in Account No. 5-01-31-221-001-U02 and Account No. 5-01-31-221-001-U03, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the December 17, 2025, Administration and Finance Committee meeting, and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4.1, et seq., the Board of County Commissioners of the County of Passaic authorizes the award of a contract to Cablevision Lightpath LLC, for the provision of voice services at various County facilities for a three-year term, beginning on July 1, 2025 and expiring on June 30, 2028, for a total amount not to exceed two hundred fifty-six thousand thirty-four dollars and sixteen cents ($256,034.16) during such term, all in accordance with the terms set forth in the attached quote and ESCNJ 23/24-10.
LET IT BE FURTHER RESOLVED that the Clerk of the Board shall print, in the official newspaper, a brief notice stating the nature, duration, service, and amount of the contract to Cablevision Lightpath LLC and maintain a copy of the resolution on file and available for public inspection in the Office of the Clerk of the Board.
LET IT BE FURTHER RESOLVED that the Clerk of the Board, County Counsel, Purchasing Agent, Director of Management and Information Systems, and the Director of the Board are authorized to take any other steps necessary to carry out the purpose of this resolution.
