RESOLUTION AUTHORIZING AWARD OF CONTRACT TO MECHANICAL SERVICE CORPORATION FOR MATERIALS, LABOR, AND INSTALLATION OF HVAC UNITS AT PASSAIC COUNTY SHERIFF’S HEADQUARTERS IN THE TOWNSHIP OF WAYNE AS PER BID SB-26-002, PURSUANT TO N.J.S.A. 40A 11-10 ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners for the County of Passaic (hereafter “Board”) is vested with decision-making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., every contract awarded by the County, for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold [40A:11-3], shall be awarded only by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, on August 27, 2025, the Purchasing Agent issued SB-26-002, HVAC Time, Material & Services (hereafter “SB-26-002”) seeking sealed proposals from qualified bidders to provide HVAC materials and services for various Passaic County Departments, to be used on an as-needed basis; and
WHEREAS, on September 9, 2025, bids were unsealed for SB-26-002 by the Purchasing Agent with one responsive bidder, Mechanical Service Corporation; and
WHEREAS, Mechanical Service Corporation has offered its prices to members of the Passaic County Cooperative #38PCCP; and
WHEREAS, on September 30, 2025, the Board adopted Resolution No. R-25-898 authorizing an award of contract to Mechanical Service Corporation to provide goods and services under SB-26-002 for a two (2) year contract term beginning January 1, 2026, and expiring on December 31, 2027 in an amount not to exceed five hundred thousand dollars ($500,000.00) per contract year, for a total award amount not to exceed one million dollars ($1,000,000.00); and
WHEREAS, the Superintendent of Buildings and Grounds is recommending an appropriation of three hundred ninety-six thousand three hundred ninety five dollars ($396,395.00) to Mechanical Service Corporation for services that will include the supply and installation of a Liebert Unit in the 911 Server Room at the Sheriff’s Headquarters, removal of the existing five ton split air conditioning and heating unit serving the 911 Control Room, and installation of a new five ton rooftop packaged HVAC unit with comparable heating and cooling capacity detailed in the proposals attached herein and made part of this Resolution; and
WHEREAS, funds are available in Account Nos. C-04-55-163-001-902, C-04-55-163-001-920, C-04-55-172-002-920 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2026 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the January 14, 2026, meeting of the Public Works Committee, and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-10 et seq., the Board of County Commissioners of the County of Passaic hereby authorizes awards of contract to Mechanical Service Corporation to provide services that will include the supply and installation of a Liebert Unit in the 911 Server Room at the Sheriff’s Headquarters, removal of the existing five ton split air conditioning and heating unit serving the 911 Control Room, and installation of a new five ton rooftop packaged HVAC unit with comparable heating and cooling capacity, pursuant to the terms and conditions of Mechanical Service Corporation’s response to SB-26-002, in an amount not to exceed three hundred ninety-six thousand three hundred ninety five dollars ($396,395.00); and
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, and Director of the Board of County Commissioners of the County of Passaic are authorized to take any other steps necessary to carry out the purpose of this resolution.
