RESOLUTION AUTHORIZING AN INCREASE IN APPROPRIATION FOR THE CONTRACT WITH ACULABS, INC. FOR LABORATORY SERVICES FOR PREAKNESSS HEALTHCARE CENTER UNDER RFP-24-012

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances and affairs of the County; and
WHEREAS, Preakness Healthcare Center (“Preakness”) is a New Jersey Department of Health licensed, 406-bed skilled nursing facility that is owned and operated by the Board; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4.3, the Board approved Resolution No. R20170872 on October 24, 2017, authorizing competitive contracting to retain a provider of laboratory services for Preakness; and
WHEREAS, the Purchasing Agent issued RFP-24-012, Laboratory Services for the Passaic County Preakness Healthcare Center (“RFP-24-012”) on December 20, 2023, responses to which were unsealed on January 9, 2024; and
WHEREAS, based on the recommendations of the review committee, the Board passed Resolution No. R-24-118 on February 13, 2024, awarding a contract to Aculabs, Inc. for the provision of laboratory services to Preakness under RFP-24-012 for an amount not to exceed thirty-five thousand dollars ($35,000.00) during a one-year term from April 1, 2024 to March 31, 2025, with the County retaining four one-year options to renew; and
WHEREAS, on February 11, 2025, the Board passed Resolution No. R-25-103, exercising the first option to renew the contract with Aculabs, Inc., for an amount not to exceed fifteen thousand dollars ($15,000.00) during the one-year option term from April 1, 2025, to March 31, 2026; and
WHEREAS, due to an unanticipated increase in need for laboratory services during the first option year, the Executive Director of Preakness has advised that it is necessary to increase the appropriation for the above-described contract with Aculabs, Inc. by an amount not to exceed fifteen thousand dollars ($15,000.00), resulting in a new total contract amount not to exceed thirty thousand dollars ($30,000.00); and
WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et seq., Aculabs, Inc. executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying that it is not involved in prohibited activities in Russia and Belarus, and the County confirmed that Aculabs, Inc. is not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, funds are available in Account No. 5-01-27-172-001-M01 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in 2025 and/or subsequent County budget(s); and
WHEREAS, this matter was discussed at the January 21, 2026, meeting of the Health and Human Services Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4.1 et seq., the Board of County Commissioners of the County of Passaic “Board”) authorizes an increase in the appropriation for the contract with Aculabs, Inc. under RFP-24-012, Laboratory Services for the Passaic County Preakness Healthcare Center, in an amount not to exceed fifteen thousand dollars ($15,000.00), resulting in a new total contract amount not to exceed thirty thousand dollars ($30,000.00).
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, Executive Director of Preakness, Purchasing Agent, and the Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
