RESOLUTION AUTHORIZING A FOURTH NO COST TIME EXTENSION FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM FY 2021 WEST MILFORD AMERICANS WITH DISABILITIES ACT BARRIER-FREE RAMP AT TOWNSHIP BUILDING #2 UNTIL AUGUST 31, 2026.

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners for the County of Passaic (hereafter “Board”) is vested with decision making powers on behalf of the County; and
WHEREAS, the Passaic County Board of County Commissioners (hereafter “Board”) adopted Resolution R-2018-0536 on June 26, 2018, authorizing the submission of a Five (5) Year Consolidated Plan for the period of FY 2018-2022 to the US Department of Housing and Urban Development (hereafter “USHUD”) in compliance with the Rules and Regulations governing the Community Development Block Grant Program (hereafter “CDBG”); and
WHEREAS, the Board adopted the FY 2021 Annual Action Plan via Resolution R-2021-0624 on June 22, 2021; and
WHEREAS, the Board is cognizant of the conditions imposed by the USHUD and included a grant allocation in the FY 2021 Annual Action Plan to the Township of West Milford (hereafter “Township”) for fifty thousand and 00/100 ($50,000.00) dollars to implement the Installation of an Americans with Disabilities Act Barrier-Free Ramp at Township Building #2; and
WHEREAS, the Board adopted Resolution No. R-23-0526 on May 23, 2023, providing a first no-cost time extension to May 31, 2024; and
WHEREAS, the Board adopted Resolution No. R-24-468 on May 21, 2024, providing a second no-cost time extension to February 28, 2025; and
WHEREAS, the Board adopted Resolution No. R-25-781 on August 12, 2025, providing a third no-cost time extension to February 27, 2026; and
WHEREAS, the Township notified the Division of Economic Development that the Township (hereafter “Division”) has been delayed in the implementation of the project due to unforeseen building conditions requiring the Township to re-evaluate the design due to water infiltration of the basement of the building and requested that the CDBG FY 2021 grant award be extended for the fourth time to August 31, 2026 to permit the Township the time to complete the project; and
WHEREAS, this matter was discussed at the January 15, 2026, meeting of the County Commissioner Planning and Economic Development Committee and is being recommended to the Board for approval; and
WHEREAS, the Board considers this matter to be a benefit to the community and its residents; and
NOW, THEREFORE, LET IT BE RESOLVED, by the Board of County Commissioners of the County of Passaic, that it hereby authorizes the fourth no-cost time extension of the Community Development Block Grant Program FY 2021 grant to the Township of West Milford to August 31, 2026, as set forth above; and
LET IT BE FURTHER RESOLVED, that the County of Passaic Commissioner Director and Director of the Division of Economic Development are hereby authorized to act as the authorized representatives of the County to execute all necessary documents and certifications on behalf of the County of Passaic
