RESOLUTION APPOINTING MEMBERS OF THE CONSTRUCTION BOARD OF APPEALS, PURSUANT TO N.J.A.C. 5:23A-1.3

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 52:27D-127, the Board established the Construction Board of Appeals to hear appeals from decisions made by construction and building code officials by citizens from those municipalities that did not establish same; and
WHEREAS, pursuant to N.J.A.C. 5:23A-1.3(a)-(b), the Construction Board of Appeals shall include five (5) regular members, with qualifications as follows: (1) Plumbing Subcode Official; (2) Electrical Subcode Official; (3) Registered Architect, or Licensed Professional Engineer with building construction experience, or other person qualified as a building subcode official; (4); Fire Protection Subcode Official; and (5) Fire Official; and
WHEREAS, pursuant to N.J.A.C. 5:23A-1.3(e), the Construction Board of Appeals shall also include two (2) special members, one of whom shall be a Licensed Professional Engineer and one of whom shall be a builder; and
WHEREAS, pursuant to N.J.A.C. 5:23A-1.3(d) and (e)(1), the Construction Board of Appeals shall include at least five alternate regular members, one for each qualification category, who shall serve and vote in the place of any absent regular member, as well as up to two alternate special members, who shall serve and vote in the place of any absent special member; and
WHEREAS, on January 21, 2025, the Board passed Resolution No. R-25-30, in relevant part reappointing Christopher Nash to the Construction Board of Appeals as the Professional Engineer Special Member, and reappointing Dennis Kolano as the Professional Engineer Special Member Alternate, each for a four-year term expiring on December 31, 2028; and
WHEREAS, Mr. Kolano has stepped down from his position on the Construction Board of Appeals; and
WHEREAS, the County Counsel is recommending that Christopher Nash be appointed to the position of Alternate Professional Engineer Special Member of the Construction Board of Appeals for the unexpired term of Dennis Kolano, effective immediately and expiring on December 31, 2028; and
WHEREAS, the County Counsel is further recommending that Nordan Murphy, who possesses the requisite qualifications to serve as the Professional Engineer Special Member of the Construction Board of Appeals, be appointed to such position for the unexpired term of Christopher Nash, effective immediately and expiring on December 31, 2028; and
WHEREAS, the County Counsel is further recommending that Michael Coscia, who possesses the requisite qualifications to serve as the Alternate Electrical Subcode Official Member of the Construction Board of Appeals, be appointed to such position for the unexpired current vacant term, effective immediately and expiring on December 31, 2028; and
WHEREAS, these appointments were discussed at the January 21, 2026, Administration & Finance Committee meeting, and are being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.A.C. 5:23A-1.3, the Board of County Commissioners of the County of Passaic authorizes the following appointments to the Construction Board of Appeals:
1. Christopher Nash as the Alternate Professional Engineer Special Member for the unexpired term of Dennis Kolano, effective immediately and expiring on December 31, 2028
2. Nordan Murphy as the Professional Engineer Special Member for the unexpired term of Christopher Nash, effective immediately and expiring on December 31, 2028.
3. Michael Coscia as the Alternate Electrical Subcode Official Member for the unexpired vacant term, effective immediately and expiring on December 31, 2028.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board is hereby authorized and directed to send a certified copy of this Resolution to the New Jersey Department of Community Affairs, Division of Codes and Standards, Office of Regulatory Affairs, on behalf of the Chairperson of the Construction Board of Appeals, in accordance with N.J.A.C. 5:23A:1-3(h).
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, and Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
