RESOLUTION AUTHORIZING CONTRACT MODIFICATION NO. 1 TO FRENCH & PARRELLO ASSOCIATES, PA FOR DESIGN OF REPLACEMENT OF a RETAINING WALL ALONG WANAQUE AVENUE IN THE BOROUGH OF POMPTON LAKES, PER RFQ-26-011, PURSUANT TO N.J.A.C. 5:30-11.6, ET SEQ.

WHEREAS, the County of Passaic (hereafter "County") is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter "Board") is vested with managing the property, finances, and affairs of the County; and
HEREAS, pursuant to N.J.S.A. 40A:11-5, et seq. the County issued RFQ-26-011, Engineers, Architects, Land Surveyors, Planners, Landscape Architects, Golf Course Architects/Designers, and Environmental and Safety/Engineering Consultants (hereafter “RFQ-26-011”) seeking qualifications for a pool of professional consultants for calendar year 2026, to be hired on an as-needed basis by the County; and
WHEREAS, on October 28, 2025, the Board passed Resolution No. R-25-1038, qualifying a pool of consultants for calendar year 2026, as recommended by the Passaic County Engineer, to be hired on an as-needed basis, which included French & Parrello Associates, PA; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.4, the County’s request for qualifications is a fair and open process, specifically, the qualification for the pool of Engineers, Architects, Land Surveyors, Planners, Landscape Architects, Golf Course Architects/Designers, and Environmental and Safety/Engineering Consultants for calendar year 2026 is publicly advertised, awarded under a process that provides for public solicitation of qualifications, established the basis of an award and disclosure process documented in writing prior to any solicitation, and is publicly opened and announced when awarded; and
WHEREAS, on May21, 2024, the Board passed Resolution No. R-24-0446, authorizing an award of contract to French & Parrello Associates, PA for design consultant services associated with the replacement of a retaining wall along Wanaque Avenue in the Borough of Pompton Lakes (hereafter “Project”); and
WHEREAS, pursuant to N.J.A.C. 5:30-11.6, et seq., a contract for professional services may be modified where the modification is necessary to address items outside the scope of the original contract that are required to complete the overall project; and
WHEREAS, the Passaic County Engineer is recommending that the Board authorize Contract Modification No. 1 under the contract with French & Parrello Associates, PA for the Project, in the increased amount of seven thousand seven hundred eighty-eight dollars ($7,788.00) in order to conduct a Phase IB Archeological Survey, which is now necessary to establish the presence or absence of archaeological remains and to assess access impacts on such remains and make recommendations, as required by the NJDEP, with a new total contract award, as a result of the increase, in the amount of two hundred eighty-four thousand eight hundred thirty-eight dollars ($284,838.00); and
WHEREAS, funds are available in Account No. C-04-55-194-009-920, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2026 and/or subsequent years’ County budget(s); and
WHEREAS, this matter was discussed at the April 1, 2026 meeting of the Public Works Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.A.C. 5:30-11.6, et seq., that the Passaic County Board of County Commissioners hereby authorizes Contract Modification No. 1 to French & Parrello for design consultant services for the Replacement of a Retaining Wall Along Wanaque Avenue in the Borough of Pompton Lakes, in the increased amount of seven thousand seven hundred eighty-eight dollars ($7,788.00), with a new total contract award, as a result of the increase, in the amount of two hundred eighty-four thousand eight hundred thirty-eight dollars ($284,838.00), as recommended by the County Engineer.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, and the Director of the Board are authorized to take any other steps necessary to carry out the purpose of this Resolution.
