RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO DTS TRUCKING, LLC, FOR SCREENED TOPSOIL FOR COUNTY PARKS, PER BID SB-26-027, PURSUANT TO N.J.S.A. 40A: 11-4, ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40:11-4, et seq., every contract awarded by the County, for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold, shall be awarded only by resolution of the Board to the lowest responsible bidder after public advertising for bid and bidding thereof; and
WHEREAS, on March 3, 2026, the Purchasing Agent issued SB-26-027, Purchase of Screened Topsoil for the County of Passaic (“SB-26-027”), seeking sealed proposals from local vendors for the provision of screened topsoil for County parks; and
WHEREAS, on March 13, 2026, bids were unsealed for SB-26-027 by the Purchasing Agent with two (2) responses received, with the lowest responsible bidder being DTS Trucking, LLC; and
WHEREAS, the Director of the Department of Parks & Recreation is recommending an award of contract to DTS Trucking, LLC for screened topsoil at the rates set forth in their response to SB-26-027 in a total amount not to exceed eighty thousand dollars ($80,000.00) for a period beginning May 14, 2026 and expiring May 13, 2027; and
WHEREAS, funds are available in Account No. O-26-56-635-002-608 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2026 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the April 1, 2026 meeting of the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4, the Board of County Commissioners of the County of Passaic authorizes an award of contract to DTS Trucking, LLC, to provide screened topsoil pursuant to SB-26-027 for a period beginning May 14, 2026, and expiring May 13, 2027 in a total amount not to exceed eighty thousand dollars ($80,000.00).
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, Director of the Board of County Commissioners, and Purchasing Agent are authorized to execute agreements with the vendors listed herein and take any other steps necessary to carry out the purpose of this Resolution.
