RESOLUTION AMENDING THE PASSAIC COUNTY PARKS ORDINANCE, PURSUANT TO N.J.S.A. 40:32-7.12

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40:32-7.7, the Board operates and maintains over sixteen thousand (16,000) acres of preserved open space and recreational facilities as part of the Passaic County Park System, through the Department of Parks and Recreation, which also includes historic sites managed by the Department of Cultural & Historic Affairs; and
WHEREAS, pursuant to N.J.S.A. 40:32-7.12, the Board may by resolution, make, alter, amend, and repeal rules and regulations for the supervision, regulation, and control of all activities carried on, conducted, sponsored, arranged, or provided for in connection with the Passaic County Park System, and may prescribe and enforce fines and penalties for the violation of any such rule or regulation; and
WHEREAS, the Director of the Department of Cultural & Historic Affairs is recommending that the Board authorize amendments to the Passaic County Park System Ordinance, including the Appendix on Historic Sites, in order to include newly opened historic sites, to add Article II, Section 49, concerning a prohibition on using metal detectors in County parks, and to amend Article III, Section 3 to reflect that photography and film permits are issued by the Director of the Department of Cultural and Historic Affairs, with the new proposed Passaic County Park System Ordinance attached hereto and made part hereof as Schedule A; and
WHEREAS, this matter was discussed at the March 11, 2026 meeting of the Public Works Committee, and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40:32-7.12 that the Board of County Commissioners of the County of Passaic authorizes amending the Passaic County Park System Ordinance to update the Appendix on Historic Sites, to add Article II, Section 49, and to amend Article III, Section 3.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, County Administrator, and Director of the Department of Parks and Recreation are authorized to take any action necessary to carry out the purpose of this Resolution.
LET IT BE FURTHER RESOLVED, pursuant to N.J.S.A. 40:24-3, this Resolution shall be published by the Clerk to the Board on the public notices page of the Passaic County website before it becomes effective.
