RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO AA BERMS, LLC FOR SNOW PLOWING SERVICES FOR THE PASSAIC COUNTY ROAD DEPARTMENT UNDER BID NO. SB-26-045, PURSUANT TO N.J.S.A. 40A:11-4, ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., every contract awarded by the County, for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold, shall be awarded only by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, on July 22, 2026, the Purchasing Agent issued Bid No. SB-26-045 Snow Plowing for Passaic County Roads (hereafter “SB-26-045”) seeking sealed proposals from qualified bidders for snow plowing services for the Passaic County Road Department on Routes One (1) through Twelve (12), Two A (2A), Six A (6A), Eight A (8A), Nine A (9A), Ten A (10A), Eleven A (11A), and Twelve A (12A), for the period beginning November 1, 2026, and ending October 31, 2027, with a one (1) year option to renew; and
WHEREAS, bid responses were received on August 21, 2026, and AA Berms, LLC of Belleville, New Jersey was the sole bidder, at the hourly and standby rates set forth below:

WHEREAS, the Supervisor of Roads is recommending an award of contract to AA Berms, LLC, at the above rates, in the amount of five hundred thousand dollars ($500,000.00); and
WHEREAS, funds are available in Account No. 6-01-26-151-001-S02, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2026 and/or subsequent years’ County budget(s); and
WHEREAS, this matter was discussed at the September 30, 2026 meeting of the Public Works Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4, et seq., that the Passaic County Board of County Commissioners hereby authorizes an award of contract to AA Berms, LLC, the lowest responsible bidder under SB-26-045, for the period beginning November 1, 2026, and ending October 31, 2027, with a one (1) year option to renew, in the amount of five hundred thousand dollars ($500,000.00), as recommended by the Supervisor of Roads; and
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, and the Director of the Board are authorized to take any other steps necessary to carry out the purpose of this Resolution.
