RESOLUTION AUTHORIZING THE DONATION OF A SURPLUS VEHICLE FROM THE PASSAIC COUNTY SHERIFF’S OFFICE TO THE HALEDON POLICE DEPARTMENT, PURSUANT TO N.J.S.A. 40A:11-36(2)

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-36 any contracting unit by resolution of its governing body may authorize by sealed bid or public auction the sale of its personal property not needed for public use; and
WHEREAS, more specifically, pursuant to N.J.S.A. 40A:11-36(2) whenever the transfer of such surplus property is to another contracting unit or any body politic to which it contributes tax raised funds, the law does not require the use of a sealed bid or public auction; and
WHEREAS, the Haledon Police Department, as another contracting unit, has inquired about the availability of any surplus vehicles that may be available from the Passaic County Sheriff’s Office (hereafter “PCSO”) for transfer in accordance with N.J.S.A. 40A:11-36(2); and
WHEREAS, the PCSO has identified a 2010 Dodge Charger, Vin #2B3CK5CT8AH217577, has come to the end of its usefulness to the County and as such is available for said transfer; and
WHEREAS, the PCSO now seeks approval of the Board to accomplish same; and
WHEREAS, this matter has been reviewed by the Law and Public Safety Committee and is being recommended to the Board of for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, that the Board of County Commissioners of the County of Passaic hereby authorizes the Passaic County Sheriff’s Office to transfer its surplus vehicle, namely a 2010 Dodge Charger, Vin #2B3CK5CT8AH217577 to the Haledon Police Department, pursuant to N.J.S.A. 40A:11-36(2).
LET IT BE FURTHER RESOLVED, that the Sheriff or his designee, Director of the Board of County Commissioners, County Administrator, County Counsel, Clerk of the Board, Chief Financial Officer, and any other employee for the County of Passaic may take any action necessary to effectuate the purpose of this Resolution.
