RESOLUTION AUTHORIZING A NON-FAIR AND OPEN CONTRACT WITH VIKEN DETECTION CORPORATION FOR THE PURCHASE OF A LEAD PAINT ANALYZER AND RELATED ACCESSORIES AND SERVICES, PURSUANT TO N.J.S.A. 40A:11-6.1(a)

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and

 

WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and

 

WHEREAS, the Department of Health Services (“Department”) is responsible for protecting and promoting the health of approximately 525,000 residents of the County; and

 

WHEREAS, pursuant to N.J.S.A. 40A:11-6.1(a), for all contracts that in the aggregate are less than the bid threshold but fifteen percent (15%) or more of that amount, the contracting agent shall award the contract after soliciting at least two (2) competitive quotations, if practicable; and

 

WHEREAS, a contract award pursuant to N.J.S.A. 40A:11-6.1(a) shall be made to the vendor whose response is most advantageous to the County, price and other factors considered; and

 

WHEREAS, the Department solicited three (3) competitive quotes for the purchase of a lead paint analyzer and related accessories and services needed by the Department; and

 

WHEREAS, Viken Detection Corporation (“Viken”) provided the quote most advantageous to the County, price and other factors considered, which is attached hereto and made part of this Resolution; and

 

WHEREAS, the Director of the Department is seeking authorization to award a non-fair and open contract for the purchase of a lead paint analyzer and related accessories and services to Viken pursuant to the attached quote, for a total amount of nineteen thousand nine hundred and fifty dollars ($19,950.00); and

 

WHEREAS, Viken executed and notarized the County’s Business Entity Disclosure Certification for non-fair and open contracts required pursuant to N.J.S.A. 19:44A-20.8, which is attached to and made part of this resolution; and

 

WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et seq., Viken executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying the vendor is not involved in prohibited activities in Russia and Belarus, and the County confirmed said vendor is not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and

 

WHEREAS, funds are available in Account No. G-01-41-755-024-223, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent County budget(s), which is attached hereto and made part of this Resolution; and

 

WHEREAS, this matter was discussed at the April 29, 2025, Health & Human Services Committee meeting, and is being recommended to the Board for approval.

 

NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-6.1(a), the Board of County Commissioners of the County of Passaic authorizes the award of a non-fair and open contract to Viken Detection Corporation for the purchase of a lead paint analyzer and related accessories and services pursuant to the attached quote, for a total amount of nineteen thousand nine hundred and fifty dollars ($19,950.00).

 

LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, Purchasing Agent, Director of the Department, and Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
