RESOLUTION TO CERTIFY ADDDITIONAL FUNDS TO COVER SB-23-003 FOR THE SEPTEMBER AND NOVEMBER HOUSEHOLD HAZARDOUS WASTE DISPOSAL CONTRACT WITH MXI ENVIRONMENTAL SERVICES, LLC, PURSUANT TO RESOLUTION R-23-0087, DATED FEBRUARY 14, 2023.

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and

 

WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners for the County of Passaic (hereafter the “Board”) is vested with decision making powers on behalf of the County; and

 

WHEREAS, the Passaic County Department of Health, Division of Recycling and Natural Resources, coordinates all solid waste and recycling planning functions on behalf of the County and its municipalities; and

 

                     WHEREAS, pursuant to Resolution R-23-0087, dated  February 14, 2023, the Board authorized a contract award to MXI Environmental Services, LLC d/b/a Maumee Express, Inc. to conduct household hazardous waste collection drives in the County of Passaic for a three (3) year term, commencing January 1, 2023 and expiring December 31, 2025  under SB-23-003; and

 

                     WHEREAS, the purpose of this resolution is to certify additional funds ($69,739) to cover SB-23-003 for the September (need to certify $30,503) and the November (need to certify $39,236) Household Hazardous Waste collection events for the County’s 2025 (year 3) Household Hazardous Waste disposal contract with MXI Environmental Services, LLC; and

 

                     WHEREAS, collection events were conducted on September 14, 2025, and November 22, 2025, and Passaic County previously certified a lesser amount than needed for an entire year’s Household Hazardous Waste program due to awaiting receipt of entitlement funds from the New Jersey Department of Environmental Protection; and

 

 WHEREAS, funds are available in Account No. G-01-41-761-023-213 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2026 and/or subsequent years’ County budget(s); and

 

WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et seq., vendor executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying the vendor is not involved in prohibited activities in Russia and Belarus, and the County confirmed vendor is not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and

 

WHEREAS, this matter was discussed at the April 29, 2026, meeting of the Health and Human Services Committee and is being recommended to the Board for approval; and

 

                     NOW, THEREFORE, LET IT BE RESOLVED, the Board of County Commissioners of the County of Passaic hereby authorizes the Department of Health, Division of Recycling and Natural Resources, to certify additional funds in the amount of ($69,739)  to cover SB-23-003 for the September and the November Household Hazardous Waste collection events for the County’s 2025 Household Hazardous Waste disposal contract with MXI Environmental Services, LLC, pursuant to Resolution R-23-0087, dated February 14, 2023; and

 

                     LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, and the Director of the Department of Human Services are hereby authorized to take the necessary actions to carry out the purpose of this Resolution.
