RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO RFS COMMERCIAL INC., FOR THER REMOVAL AND REPLACEMENT OF FLOORING ON THE SECOND FLOOR OF THE PASSAIC COUNTY COURTHOUSE AT 77 HAMILTON STREET IN THE CITY OF PATERSON, PURSUANT TO N.J.S.A. 40A: 11-12.

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40:11-12, et seq., the County may, without advertising for bids, or having rejected all bids obtained pursuant to advertising thereof, purchase any goods or services under any contract or contracts for such goods or services entered into on behalf of the State of New Jersey by the Division of Purchase and Property in the Department of Treasury; and
WHEREAS, RFS Commercial, Inc., submitted competitive pricing for G2005- Carpet and Floor Covering, Supplies and Installation- Statewide, Master Blanket Purchase Order 23-FOOD-47764, to the State of New Jersey, Division of Purchase and Property in the Department of Treasury; and
WHEREAS, the Superintendent of Buildings & Grounds is recommending the Board authorize an award of contract to RFS Commercial Inc., for the removal and replacement of flooring on the second floor of the Passaic County Courthouse at 77 Hamilton Street in the City of Paterson, in an amount not to exceed thirty-two thousand five hundred eighty-five dollars and eighty-eight cents ($32,585.88), in accordance with the proposal received from RFS Commercial, Inc., attached hereto and made part hereof; and
WHEREAS, funds are available in Account No. 6-01-44-900-003-002, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2026 and/or subsequent years’ County budget (s), which is attached to and made part of this Resolution
WHEREAS, this matter was discussed at the September 30, 2026 meeting of the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-12, the Passaic County Board of Commissioners hereby authorizes an award of contract to RFS Commercial Inc., for the removal and replacement of flooring on the second floor of the Passaic County Courthouse at 77 Hamilton Street in the City of Paterson, in an amount not to exceed thirty-two thousand five hundred eighty-five dollars and eighty-eight cents ($32,585.88) as recommended by the Superintendent of Buildings & Grounds.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, and Director of the Passaic County Board of County Commissioners are authorized to execute an agreement and take any other steps necessary to carry out the purpose of this resolution.
