RESOLUTION AUTHORIZING CHANGE ORDER NO. 1 TO COLONNELLI BROTHERS, INC., FOR ON CALL BRIDGE AND CULVERT REPAIRS AT FOUR BRIDGES: EIGHTH STREET BRIDGE #1600-004 IN THE CITY OF PASSAIC, UNION AVENUE BRIDGE #1600-022 IN THE TOWNSHIP OF LITTLE FALLS, WEST BROOK ROAD BRIDGE #1600-491 IN THE BOROUGH OF RINGWOOD, AND BURNT MEADOW ROAD CULVERT IN THE TOWNSHIP OF WEST MILFORD, PER BID C-24-002, PURSUANT TO N.J.A.C. 5:30-11.3, ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., every contract awarded by the County, for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold, shall be awarded only by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, on December 13, 2023, the Purchasing Agent issued Bid No. C-24-002, On- Call Bridge & Culvert Repair Projects (hereafter “C-24-002”) seeking sealed proposals from qualified bidders for on-call bridge and culvert repairs on an as-needed basis beginning January 1, 2024 and expiring December 31, 2025; and
WHEREAS, on February 2, 2024, the Board passed Resolution R-24-0057 qualifying a list of five contractors and unit prices to perform on-call bridge repairs and culvert repairs on an as-needed basis for the period beginning on January 1, 2024, and ending December 31, 2025, which included Colonnelli Brothers, Inc.; and
WHEREAS, on July 15, 2025 the Board approved Resolution No. R-25-0661, authorizing an award of contract to Colonnelli Brothers, Inc., for on-call bridge repairs to Union Avenue Bridge No. 1600-022 in the Township of Little Falls, Eight Street Bridge No. 1600-004 in the City of Passaic, West Brook Road Bridge No. 1600-491 in the Borough of Ringwood, and Burnt Meadow Road Culvert No. 1600-247 in the Township of West Milford (hereafter “Project”) in an amount not to exceed one hundred seventy-six thousand three hundred fifty dollars ($176,350.00); and
WHEREAS, pursuant to N.J.A.C. 5:30-11.3, et seq., the Board can authorize, permit, or accept change orders for work performed, services rendered, materials, supplies, or equipment delivered or provided pursuant to the conditions as set forth therein; and
WHEREAS, the Passaic County Engineer is recommending that Change Order No. 1 be authorized for a net deduction to the Project in the amount of six thousand seven hundred ninety-six dollars and fifty cents ($6,796.50) due to final field quantity adjustments, with a new total contract amount, as a result of the decrease, of one hundred sixty-nine thousand five hundred fifty-three dollars and fifty cents ($169,553.50); and
WHEREAS, this matter was discussed at the April 29, 2026 meeting of the Public Works Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.A.C. 5:30-11.3, et seq., that the Passaic County Board of County Commissioners hereby authorizes Change Order No. 1 to Colonnelli Brothers, Inc., for on-call bridge repairs to Union Avenue Bridge No. 1600-022 in the Township of Little Falls, Eight Street Bridge No. 1600-004 in the City of Passaic, West Brook Road Bridge No. 1600-491 in the Borough of Ringwood, and Burnt Meadow Road Culvert No. 1600-247 in the Township of West Milford, in the decreased amount of six thousand seven hundred ninety-six dollars and fifty cents ($6,796.50), with a new total contract amount, as a result of the decrease of one hundred sixty-nine thousand five hundred fifty-three dollars and fifty cents ($169,553.50).
LET IT BE FURTHER RESOLVED, that the County Engineer is authorized and directed to comply with all of the general requirements for change orders as set forth in N.J.A.C. 5:30-11.3, et seq.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, and the Director of the Board are authorized to take any other steps necessary to carry out the purpose of this Resolution.
