RESOLUTION AUTHORIZING THE COUNTY TO GRANT AN EASEMENT TO THE ROMAN CATHOLIC DIOCESE OF PATERSON ON A PORTION OF BLOCK 4709, LOT 6 IN THE CITY OF PATERSON, PURSUANT TO N.J.S.A. 40A:12-16.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the County is the owner in fee of certain property located within the City of Paterson at Block 4709, Lot 6 as shown on the Official Tax Map of the City of Paterson (hereafter “County Property”); and
WHEREAS, the County is in the process of a major construction project known as the 11 Marshall Street Redevelopment Project - Phase II (hereafter “Project”), which will be constructed on the County Property; and
WHEREAS, during the design phase of the Project, it was discovered that the Roman Catholic Diocese of Paterson’s parking lot directly north of the County Property encroaches slightly onto the County Property; and
WHEREAS, also during the design phase of the Project, it was determined that the County would need a temporary construction easement on Roman Catholic Diocese of Paterson’s property for the purposes of staging and for the purposes of installing foundation supports; and
WHEREAS, pursuant to N.J.S.A. 40A:12-16, the County is permitted to exchange rights or interests in its lands for other rights or interests desired for public use where the governing body determines the interests received are at least equal in value and more advantageous to the County; and
WHEREAS, the proposed exchange of an easement for a temporary construction easement required for the Project falls squarely within that authorization; and
WHEREAS, the County desires to formally grant an easement to the Roman Catholic Diocese of Paterson for the area where Roman Catholic Diocese of Paterson’s parking lot encroaches onto the County Property, and in exchange the County will receive a temporary construction easement necessary for the Project from Roman Catholic Diocese of Paterson, such agreements attached hereto and made part hereof; and
WHEREAS, this matter was discussed at the September 30, 2026 meeting of the Public Works Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:12-16, that the Board of County Commissioners of the County of Passaic hereby grants an easement to Roman Catholic Diocese of Paterson, on certain portions of County-owned property at Block 4709, Lot 6 in the City of Paterson, as delineated in the Deed of Easement, attached hereto and made part hereof.
LET IT BE FURTHER RESOLVED, the Director of the Board of County Commissioners, Clerk of the Board and County Counsel are hereby authorized to execute a Deed of Easement on behalf of Passaic County.
