RESOLUTION AUTHORIZING THE EXECUTION AND ACCEPTANCE OF THE AMENDED FEDERAL TRANSPORTATION ALTERNATIVES PROGRAM GRANT FROM THE STATE OF NEW JERSEY, DEPARTMENT OF TRANSPORTATION, FOR THE HIGHLANDS RAIL TRAIL PHASE I PROJECT, PURSUANT TO N.J.S.A. 40A:5-30

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, on December 27, 2022, the Board passed Resolution No. R-22-1242, authorizing the acceptance of a Federally-sourced grant from the State of New Jersey, Department of Transportation, under the Transportation Alternatives Grant Program, Agreement Number 2022-DT-BLA1-05, in the amount of one million nine hundred eight thousand eight hundred ninety-five dollars and fifty cents ($1,908,895.50); and
WHEREAS, the County Engineer is now seeking authorization to accept and execute the Grant Modification Agreement with the State of New Jersey, Department of Transportation, increasing the County’s award under the Transportation Alternatives Grant Program, Agreement Number 2022-DT-BLA1-05 by one million four hundred ninety-one thousand one hundred four dollars and fifty cents ($1,491,104.50), with a new total grant under this program in the amount of three million four hundred thousand dollars ($3,400,000.00); and
WHEREAS, the funding received under the Transportation Alternatives Grant Program, Agreement Number 2022-DT-BLA1-05 will be used to fund the construction phase of the Highlands Rail Trail Phase I Project in the Borough of Wanaque; and
WHEREAS, this matter was discussed at the February 7, 2024 meeting of the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:5-30, that the Board of County Commissioners of the County of Passaic authorizes the acceptance and execution of the Grant Modification Agreement under the Transportation Alternatives Grant Program, Agreement Number 2022-DT-BLA1-05 from the State of New Jersey, Department of Transportation, increasing the grant award for the construction phase of the Highland Rail Trail Phase I Project in the Borough of Wanaque to three million four hundred thousand dollars ($3,400,000.00).
LET IT BE FURTHER RESOLVED that the Clerk of the Board, County Counsel, County Engineer, and Director of the Board of County Commissioners are authorized to take all steps necessary to carry out the purpose of this Resolution.
