RESOLUTION REQUESTING PERMISSION FROM THE DIRECTOR OF THE DIVISION OF LOCAL GOVERNMENT SERVICES FOR THE DEDICATION BY RIDER FOR A WORKERS’ COMPENSATION INSURANCE FUND, PURSUANT TO N.J.S.A. 40A:10-13

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, permission is required of the Director of the Division of Local Government Services for approval as a dedication by rider of revenues received by a county when the revenue is not subject to reasonably accurate estimates in advance; and
WHEREAS, N.J.S.A. 40A:10-13 provides for the receipt of budget appropriations by the county to provide for the operating costs to administer this act; and
WHEREAS, N.J.S.A. 40A:4-39 provides the dedicated revenues anticipated from the Workers’ Compensation Insurance Fund are hereby appropriated for the purpose to which said revenue is dedicated by statute or other legal requirement; and
WHEREAS, this matter was discussed at the April 29, 2026, Administration and Finance Committee meeting, and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, the Board of County Commissioners of the County of Passaic hereby requests permission from the Director of the Division of Local Government Services to pay for expenditures of the Workers’ Compensation Insurance Fund, pursuant to N.J.S.A. 40A:10-13.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board is directed to forward two certified copies of this Resolution to the Director of the Division of Local Government Services.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, Chief Financial Officer, and Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
