RESOLUTION AUTHORIZING AN INCREASE IN APPROPRIATION TO 22ND CENTURY TECHNOLOGIES, INC. FOR TEMPORARY STAFFING SERVICES, PURSUANT TO N.J.S.A. 40A:11-12

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the County, through its Department of Senior Services, Division of Weatherization and Home Energy (“Division”), administers various programs to reduce energy costs for low-income residents in the County by improving energy efficiency; and
WHEREAS, due to the uncertainty of federal funding, the Division’s Home Energy Assistance Program experienced a reduction in permanent staffing, and accordingly requires temporary staffing services in order to maintain effective provision of services to clients; and
WHEREAS, pursuant to N.J.S.A. 40A:11-12, the County may, without advertising for bids, or having rejected all bids obtained pursuant to advertising thereof, purchase any goods or services under any contract(s) for such goods and services entered into on behalf of the State of New Jersey, Department of the Treasury, Division of Purchase and Property; and
WHEREAS, 22nd Century Technologies, Inc. has been awarded State Contract No. 23-GNSV1-35293 for M2001 - Temporary Staffing Services, by the State of New Jersey, Department of the Treasury, Division of Purchase and Property; and
WHEREAS, on January 27, 2026, the Board adopted Resolution No. 26-0055, authorizing a contract with 22nd Century Technologies, Inc. for temporary staffing services in accordance with State Contract No. 23-GNSV1-35293, for an amount not to exceed ten thousand dollars ($10,000.00), based on available grant funding at the time; and
WHEREAS, following the receipt of 2026 Home Energy grant funding, the Division is requesting an increase of appropriation for the above-described contract with 22nd Century Technologies, Inc., in an amount not to exceed ninety thousand six hundred dollars ($90,600.00), to cover the provision of necessary temporary staffing services for the Division’s Home Energy Assistance Program, in accordance with State Contract No. 23-GNSV1-35293; and
WHEREAS, pursuant to N.J.S.A. 52:32-60.1, et seq., 22nd Century Technologies, Inc. executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying that it is not involved in prohibited activities in Russia and Belarus, and the County confirmed that 22nd Century Technologies, Inc. is not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, funds are available in Account No. G-01-41-706-026-213 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2026 and/or subsequent County budget(s), which is attached hereto and made part of this Resolution; and
WHEREAS, this matter was discussed at the February 25, 2026, Health & Human Services Committee meeting, and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-12, the Board of County Commissioners of the County of Passaic authorizes an increase in the appropriation to 22nd Century Technologies, Inc. for temporary staffing services under State Contract No. 23-GNSV1-35293, in an amount not to exceed ninety thousand six hundred dollars ($90,600.00), resulting in a new total contract amount not to exceed one hundred thousand six hundred dollars ($100,600.00).
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, Director of the Division, Purchasing Agent, and Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
