RESOLUTION AWARDING A CONTRACT FOR ON BI-ANNUAL SUBSCRIPTION FEES FOR THE P-25 RADIO SYSTEM TO NJOIT FISCAL SERVICES FOR THE PASSAIC COUNTY SHERIFF’S OFFICE, PURSUANT TO N.J.S.A. 40A:11-5(2).

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the Passaic County Sheriff’s Office (hereinafter PCSO) requires a subscription with the New Jersey Office of Information Technology (NJOIT) Fiscal Services in order to use the P-25 Radio system to communicate between units in the field, the dispatch center and agencies in surrounding areas; and
WHEREAS, pursuant to N.J.S.A. 40A:11-3 when the cost or price of any contract awarded by the contracting agent in the aggregate does not exceed in a contract year the bid threshold, the contract may be awarded by a purchasing agent or other employee so designated by the governing body when so authorized by ordinance or resolution as appropriate to the contracting unit without public advertisement for bids; and
WHEREAS, on June 30, 2020 the Board approved Resolution No. R20200514 setting the bid threshold at forty-four thousand dollars ($44,000.00), in accordance with the law; and
WHEREAS, pursuant to N.J.S.A. 40A:4-5(2), any contract the amount of which exceeds the bid threshold, may be negotiated and awarded by the governing body without public advertising for bids and bidding therefore and shall be awarded by resolution of the governing body if it is made or entered into with the State of New Jersey; and
WHEREAS, the PCSO is seeking to make payment in the amount of twenty-five thousand six hundred and twenty dollars ($25,620.00) for the period from April 1, 2022 through March 31, 2023; and
WHEREAS, funds are available in Account Nos. 3-01-25-157-001-213 ($12,810.00) and 3-01-22-130-001-213 ($12,810.00) or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed by the Law and Public Safety Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-5 that the Board of County Commissioners of the County of Passaic authorizes payment to the New Jersey Office of Information Technology Fiscal Services for use of the P-25 Radio System during the period of April 1, 2022 through March 31, 2023 in an amount not to exceed twenty-five thousand six hundred and twenty dollars ($25,620.00).
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, and the Director of the Board are authorized to take any other steps necessary to carry out the purpose of this resolution.
