RESOLUTION AUTHORIZING CONTRACT MODIFICATION NO. 7 TO BOSWELL ENGINEERING FOR THE DUNDEE ISLAND PARK PHASE II IMPROVEMENT PROJECT, PURSUANT TO N.J.A.C 5:30-11.6

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of Commissioners for the County of Passaic (hereafter “Board”) is vested with decision-making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-5, et seq., the County issued RFQ-24-043 seeking qualifications for a pool of engineers, architects, land surveyors, planners, landscape architects, environmental health and safety/engineering consultants to be hired on an as-needed basis to provide professional services to the County; and
WHEREAS, on December 8, 2020, the Board passed Resolution No. R2020-1102 qualifying a pool of engineers, architects, land surveyors, planners, landscape architects, environmental health and safety/engineering consultants for calendar year 2021, as recommended by the Passaic County Engineer, to be hired on an as-needed basis, which included Boswell Engineering; and
WHEREAS, on April 27, 2021, the Board passed Resolution No. R2021-0437 awarding a contract to Boswell Engineering for consulting engineering services and Licensed Site Remediation Services for the Dundee Island Park Improvements Phase II Project in the City of Passaic in the amount of six hundred twenty-five thousand, nine hundred seventy-five dollars ($625,975.00); and
WHEREAS, on November 9, 2021, the Board Resolution No. R2021-1048 authorizing the first contract modification with Boswell Engineer for Consulting Engineering Services and Licensed Site Remediation Services for the Dundee Island Park Improvements Phase II Project increasing the appropriation by six thousand, five hundred dollars ($6,500.00), for a new total award in the amount of six hundred thirty-two thousand, four hundred seventy-five dollars ($632,475.00); and
WHEREAS, on December 14, 2021, the Board Resolution No. R2021-1156 authorizing the second contract modification with Boswell Engineer for Consulting Engineering Services and Licensed Site Remediation Services for the Dundee Island Park Improvements Phase II Project increasing the appropriation by twenty-two thousand dollars ($22,000.00), for a new total award in the amount of six hundred fifty-four thousand, four hundred seventy-five dollars ($654,475.00); and
WHEREAS, on March 8, 2022, the Board approved Resolution No. R-22-0192 authorizing the third contract modification with Boswell Engineer for Consulting Engineering Services and Licensed Site Remediation Services for the Dundee Island Park Improvements Phase II Project increasing the appropriation by eight thousand, four hundred seventy-seven dollars ($8,477.00), for a new total award in the amount of six hundred sixty-two thousand, nine hundred fifty-two dollars ($662,952.00); and
WHEREAS, on May 24, 2022, the Board approved Resolution No. R-22-0459 authorizing the fourth contract modification with Boswell Engineer for Consulting Engineering Services and Licensed Site Remediation Services for the Dundee Island Park Improvements Phase II Project increasing the appropriation by fifty-one thousand, nine hundred dollars ($51,900.00), for a new total award in the amount of seven hundred fourteen thousand, eight hundred fifty-two dollars ($714,852.00); and
WHEREAS, on September 5, 2023, the Board approved Resolution No. R-23-0827, authorizing the fifth contract modification with Boswell Engineer to provide additional services for the Dundee Island Park Improvements Phase II Project increasing the appropriation by thirty-five thousand dollars ($35,000.00), for a new total contract award in the amount of seven hundred forty-nine thousand, eight hundred fifty-two dollars ($749,852.00); and
WHEREAS, on August 13, 2024, the Board approved Resolution No. R-24-719, authorizing the sixth contract modification with Boswell Engineer to prepare easement documents for the construction and maintenance of the proposed improvements upon non-County properties, increasing the appropriation by three thousand five hundred dollars ($3,500.00), for a new total contract amount of seven hundred fifty-three thousand three hundred fifty-two dollars ($753,352.00); and
WHEREAS, the Passaic County Engineer is recommending that the Board authorize a seventh contract modification with Boswell Engineer to conduct an ecological evaluation for the Project, in an increased amount of forty thousand dollars ($40,000.00), for a new total contract award in the amount of seven hundred ninety-three thousand three hundred fifty-two dollars ($793,352.00); and
WHEREAS, funds are available in Account No. C-04-55-166-002-920 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent years’ County budget (s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the January 29, 2025 meeting of the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.A.C. 5:30-11.6 that the Board of County Commissioners of the County of Passaic authorizes Contract Modification No. 7 to Boswell Engineer for the Dundee Island Park Improvements Phase II Project in the increased amount of forty thousand dollars ($40,000.00), with a new total contract amount, as a result of the increase, in the amount of seven hundred ninety-three thousand three hundred fifty-two dollars ($793,352.00).
LET IT BE FURTHER RESOLVED, the Clerk of the Board shall print in the official newspaper a brief notice stating the nature, duration, service, and amount of the contract modification to Boswell Engineering and maintain a copy of the resolution on file and available for public inspection in the Office of the Clerk of the Board.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, and Director of the Board of County Commissioners are authorized to execute the contract modification and take any other steps necessary to carry out the purpose of this resolution.
