RESOLUTION AUTHORIZING A PURCHASE FROM MAINTAINCO, INC., FOR A HELI FORKLIFT OR EQUIVALENT FOR THE PASSAIC COUNTY PARKS AND RECREATION DEPARTMENT, PURSUANT TO N.J.S.A. 40A:11-4

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereafter “Board”) are vested with decision making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40:11-4, et seq., every contract awarded by the County, for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold, shall be awarded only by resolution of the Board to the lowest responsible bidder after public advertising for bid and bidding thereof; and
WHEREAS, on June 3, 2026, the Purchasing Agent issued SB-26-037, HELI CPYD25-KU1H Forklift or Equivalent for Passaic County Parks and Recreation Department (“SB-26-037”), seeking sealed proposals from local vendors for the provision of a forklift for County parks; and
WHEREAS, on June 16, 2026, bids were unsealed for SB-26-037 by the Purchasing Agent with two (2) responses received, with the lowest responsible bidder being Maintainco, Inc.; and
WHEREAS, the Director of the Department of Parks & Recreation is recommending an award of contract to Maintainco, Inc., for a Heli forklift or equivalent at the price set forth in their response to SB-26-037 in a total amount not to exceed thirty-five thousand four hundred fifty-four dollars ($35,454.00); and
WHEREAS, delivery must be made within 180 days of execution of the award with pricing to remain in effect for 12 consecutive months after the contract is awarded and Maintainco, Inc., has offered their prices to members of the Passaic County Cooperative #38PCCP for the term of July 14, 2026 - July 13, 2027; and
WHEREAS, funds are available in Account No. 6-01-44-900-003-000 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2026 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the July 1, 2026 meeting of the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4, the Board of County Commissioners of the County of Passaic authorizes an award of contract to Maintainco, Inc., for a Heli forklift or equivalent at the price set forth in their response to SB-26-037 in a total amount not to exceed thirty-five thousand four hundred fifty-four dollars ($35,454.00) for a contract period beginning on July 14, 2026 and expiring on July 13, 2027.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, Director of the Board of County Commissioners, and Purchasing Agent are authorized to execute agreements with the vendors listed herein and take any other steps necessary to carry out the purpose of this Resolution.
