RESOLUTION TO INCREASE THE AMOUNT APPROPRIATED FOR TM ADAMS, INC., WHO WAS QUALIFIED THROUGH RFQ-25-083: EXPAND POOL WEATHERIZATION ASSISTANCE PROGRAM (WAP) RESIDENTIAL HEATING SYSTEMS UPGRADES AND REPAIRS, ON AN AS-NEEDED BASIS BY THE DIVISION OF WEATHERIZATION, PURSUANT TO N.J.S.A. 40A:11-5, ET SEQ.

WHEREAS, the County of Passaic (the “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and

 

WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereinafter the “Board”) are vested with decision-making powers on behalf of the County; and

 

WHEREAS, the County, through its Division of Weatherization and Home Energy (hereafter “Division”) of the Department of Senior Services administers various programs to reduce energy costs for low-income residents in Passaic County by improving energy efficiency; and

 

WHEREAS, pursuant to N.J.S.A. 40A:11-5, et seq., the Purchasing Agent issued RFQ-25-083: Expand Pool Weatherization Assistance Program (WAP) Residential Heating Systems Upgrades and Repairs (hereafter “RFQ-25-083”), seeking qualifications for a pool of qualified contractors to provide professional weatherization remediation services consisting of insulation, ventilation, and related work activity for residents of the County; and

 

WHEREAS, pursuant to N.J.S.A. 19:44A-20.4, the County’s request for qualifications is a fair and open process, specifically, the qualification for RFQ-25-083 is publicly advertised, awarded under a process that provides for public solicitation of qualifications, established the basis of an award and disclosure process documented in writing prior to any solicitation, and is publicly opened and announced when awarded; and

 

WHEREAS, pursuant to Resolution R-25-639, dated July 15, 2025, the Board qualified and awarded a contract to TM Adams, Inc. of Saddle Brook, NJ, on an as-needed basis, for the period August 1, 2025, through July 31, 2026, with an appropriation amount of $35,000.00; and

 

WHEREAS, the Division’s final invoice for TM Adams, Inc. (requisition R5-13743), in the amount of $12,360.00, exceeds the $35,000.00 appropriation by $2,877.50; and

 

WHEREAS, as a result, the Division is requesting to add HIP 2024 grant funds in the amount of $2,877.50 to the appropriation amount for vendor TM Adams, Inc., through RFQ-25-083, increasing the total appropriation amount to $37,877.50; and

 

WHEREAS, the appropriation increase of $2,877.50 is part of the $12,360.00 amount of R5-13743; and

 

WHEREAS, funds are available in Account No. G-01-41-707-024-213 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and

                     

WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et seq., vendor executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying the vendor is not involved in prohibited activities in Russia and Belarus, and the County confirmed vendor is not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and

 

                     WHEREAS, this matter was discussed at the December 2, 2025, meeting of the Health and Human Services Committee and is being recommended to the Board for approval; and

 

                     NOW THEREFORE LET IT BE RESOLVED, that the Board of County Commissioners of the County of Passaic authorizes the addition of HIP 2024 grant funds in the amount of $2,877.50 to the appropriation amount for TM Adams, Inc., increasing the total appropriation amount for RFQ-25-083 to $37,877.50; and

 

                     LET IT BE FURTHER RESOLVED, that the Director of the Board, the Clerk to the Board, County Counsel, Director to the Weatherization & Home Energy Division, and Purchasing Agent are authorized to execute any agreement and take any other steps necessary to carry out the purpose of this Resolution; and
