RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO H&M ROHSLER NURSERY, INC., TO PROVIDE PLANTS, FLOWERS AND GARDENING PRODUCTS FOR THE PASSAIC COUNTY PARK SYSTEM, PER SB-26-038, PURSUANT TO N.J.S.A 40A:11-4 ET SEQ.

WHEREAS, the County of Passaic (“County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Passaic Board of County Commissioners (hereafter “Board”) is vested with decision-making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., for every contract awarded by the County for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold established pursuant to N.J.S.A. 40A:11-3, shall be awarded by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, on June 16, 2026, the Passaic County Purchasing Agent (“Purchasing Agent”) issued SB-26-038 seeking a Bid Plant Catalog Bid (“SB-26-038”), in compliance with N.J.S.A. 40A:11-4 et seq.; and
WHEREAS, on June 26, 2026, bids were unsealed for SB-26-038 by the Purchasing Agent with one (1) response from H&M Rohsler Nursery Inc.; and
WHEREAS, the Director of the Department of Parks and Recreation is recommending an award of contract to H&M Rohsler Nursery Inc., for a contract period from September 7, 2026 and expiring on September 6, 2028 with the following discounts in their catalog:

1. 2026 Perennial Catalog 1 & 2 Gallon: 30%
2. 2026 Perennial Grasses: 30%
3. 2026 Nursery Catalog: 30%
4. 2026 Annual Catalog: 25%
Delivery
1. 2026 Perennial Catalog 1 & 2 Gallon: 10%
2. 2026 Perennial Grasses: 10%
3. 2026 Nursery Catalog: 10%
4. 2026 Annual Catalog: 10%
WHEREAS, the Director of the Department of Parks & Recreation recommends an award of contract to H&M Rohsler Nursery Inc., to provide plants, flowers and gardening products for the Passaic County Park System at the discount prices referenced herein this Resolution, in an amount not to exceed one hundred thirty-five thousand dollars ($135,000.00) for a contract period beginning on September 7, 2026 and expiring on September 6, 2028; and
WHEREAS, funds are available in Account No. 0-26-56-635-002-608, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in 2026 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the July 29, 2026 meeting of the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4, that the Board of County Commissioners of the County of Passaic authorizes the award of contract to H&M Rohsler Nursery Inc., to provide plants, flowers and gardening products for the Passaic County Park System at discount prices referenced herein this Resolution, in an amount not to exceed one hundred thirty-five thousand dollars ($135,000.00) for a contract period beginning on September 7, 2026 and expiring on September 6, 2028.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, Purchasing Agent, and Director of the Department of Parks & Recreation execute any documents required and take any other steps necessary to carry out the purpose of this resolution.
