RESOLUTION AUTHORIZING THE DEPARTMENT OF CULTURAL & HISTORIC AFFAIRS TO ACQUIRE HISTORIC ARTIFACTS FOR PUBLIC DISPLAY, PURSUANT TO N.J.S.A. 40A:11-5(1)(k)

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereafter “Board”) are vested with decision making powers on behalf of the County; and
WHEREAS, the Department of Cultural & Historic Affairs (hereafter “Department”) creates and maintains a flourishing cultural landscape throughout the County, developing, promoting, and implementing extensive public programs to encourage public awareness and visitation to the County’s various historic sites; and
WHEREAS, pursuant to N.J.S.A. 40A:11-5(1)(k), contracts may be negotiated and awarded by the Board without public advertising for bids and bidding thereof and shall be awarded by resolution of the Board if it is for the acquisition of artifacts or other items of unique intrinsic, artistic, or historical character; and
WHEREAS, the Director of the Department desires to expand the current collection of historic objects on display at County museums, in an effort to preserve Passaic County history; and
WHEREAS, the Director of the Department is seeking authorization from the Board to acquire historic objects to display at County museums at auctions and private sales in the area; and
WHEREAS, the Director of the Department will comply with the provisions of N.J.S.A. 40A:11-5 et seq. and N.J.S.A. 19:44A-20.8 when acquiring historic artifacts for display at County museums; and
WHEREAS, this matter was discussed at the January 10, 2024 meeting of the Public Works Committee, and is being recommended to the Board for approval; and
NOW, THEREFORE LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-5(1)(k), the Board of County Commissioners of the County of Passaic authorizes the Director of the Department of Cultural & Historic Affairs to acquire historic artifacts to be displayed at museums in Passaic County.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, the Director of the Department of Cultural & Historic Affairs, and the Director of the Board are authorized to take any other steps necessary to carry out the purpose of this resolution.
