RESOLUTION AUTHORIZING CHANGE-ORDER NO. 2 TO ON-LINE CONTRACTING, INC., FOR ON-CALL DRAINAGE REPAIRS AT 79 CEDAR GROVE ROAD IN THE TOWNSHIP OF LITTLE FALLS, PER BID C-24-001, PURSUANT TO N.J.A.C. 5:30-11.3, ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and 

 

WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners for the County of Passaic (hereafter “Board”) is vested with decision-making powers on behalf of the County; and 

 

WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., every contract awarded by the County, for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold, shall be awarded only by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and 

 

WHEREAS, on December 12, 2023, the Board passed Resolution R-23-1170 qualifying a list of eight contractors and unit prices to perform on-call drainage projects on an as-needed basis for the period beginning on January 1, 2024, and ending December 31, 2025, which included On-Line Contracting, Inc.; and 

 

WHEREAS, on August 13, 2024, the Board passed Resolution No. R-24-704, authorizing an award of contract to On-Line Contracting, Inc. to complete drainage repairs at 79 Cedar Grove Road in the Township of Little Falls, in an amount not to exceed two hundred twenty-four thousand seventy-nine dollars ($224,079.00); and

 

WHEREAS, on December 30, 2024, the Board passed Resolution No. R-24-1244, authorizing Change Order No. 1, which had no cost increases associated with such Change Order; and

 

WHEREAS, the County Engineer is recommending that the Board approve Change Order No. 2 under the contract with On-Line Contracting, Inc., in the increased amount of twenty-two thousand six hundred forty-three dollars and twenty cents ($22,643.20) due to final contract adjustments and the addition of supplemental items needed to complete the project, with a new total award amount, as a result of the increase, in the amount of two hundred forty-six thousand seven hundred twenty-two dollars and twenty cents ($246,722.20); and

 

WHEREAS, this project is partially funded by the Federal Emergency Management Agency (hereafter “FEMA”); and

 

 WHEREAS, funds are available in Account No. C-04-55-175-001-901, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and

 

WHEREAS, this matter was discussed at the February 26, 2025 meeting of the Public Works Committee and is being recommended to the Board for approval.

 

NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4, et seq. the Board of County Commissioners of the County of Passaic authorizes Change Order No. 2 for the contract with On-Line Contracting, Inc., in the increased amount of twenty-two thousand six hundred forty-three dollars and twenty cents ($22,643.20), with a new total award amount, as a result of the increase, in the amount of two hundred forty-six thousand seven hundred twenty-two dollars and twenty cents ($246,722.20).

 

LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, Director of the Board of County Commissioners, and Purchasing Agent are authorized to execute an agreement with On-Line Contracting, Inc., execute any documents required by FEMA, and take any other steps necessary to carry out the purpose of this Resolution.
