RESOLUTION TO EXTEND A CONTRACT WITH EWING IRRIGATION PRODUCTS, INC., A SECOND TIME, FOR CATALOG % DISCOUNTS FOR IRRIGATION AND DRAINAGE SUPPLIES FOR THE COUNTY OF PASSAIC PREAKNESS VALLEY GOLF COURSE, PER BID SB-23-013 AND PURSUANT TO N.J.S.A. 40A:11-15

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Passaic Board of County Commissioners (hereafter “Board”) is vested with decision making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., for every contract awarded by the County for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold established pursuant to N.J.S.A. 40A:11-3, shall be awarded by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, on November 14, 2022, the Purchasing Agent issued SB-23-013 Discount Pricing Irrigation and Drainage Supplies, Bid No. SB-23-013 (hereafter “SB-23-013”) seeking sealed proposals from qualified bidders for irrigation and drainage supplies, to be used on an as-needed basis; and
WHEREAS, on November 29, 2022, bids were unsealed for SB-23-013 by the Purchasing Agent with only one (1) response from qualified bidders received from Ewing Irrigation Products, Inc; and
WHEREAS, on December 27, 2022, the Board passed Resolution No. R-22-1243, authorizing an award of contract to Ewing Irrigation Products, Inc., to provide irrigation and drainage supplies under SB-23-013, for the period beginning March 1, 2023 through February 28, 2025; and
WHEREAS, pursuant to N.J.S.A. 40A:11-15, a contract may be extended by mutual agreement of the parties to the contract when a contracting unit has commenced rebidding prior to the time the contract expires; and
WHEREAS, on February 11, 2025, the Board passed Resolution No. R-25-0119, extending the contract with Ewing Irrigation Products pursuant to N.J.S.A. 40A:11-15 until March 11, 2025, as a new bid was being advertised; and
WHEREAS, on February 18, 2025, the Purchasing Agent issued SB25-038 Expand Pool Catalog % Discount Pricing-Irrigation and Drainage Supplies for the County of Passaic Preakness Valley Golf Course, which will not be due until March 4, 2025; and
WHEREAS, the Director of the Department of Parks & Recreation is seeking to extend the contract with Ewing Irrigation Products, Inc., a second time, this time to March 25, 2025, so that the County may continue to procure irrigation and drainage supplies while reviewing responses to SB-25-038; and
WHEREAS, funds are available in Account No. 3-01-28-198-002-Ip1 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent years’ County budget (s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at a meeting on January 29, 2025 by the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-15, that the Board of County Commissioners of the County of Passaic authorizes that the contract with Ewing Irrigation Products, Inc., under SB-23-013, set to expire on February 28, 2025, is hereby extended to March 25, 2025.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, and Director of the Board are authorized to execute the contracts and take any other steps necessary to carry out the purpose of this resolution.
