RESOLUTION AUTHORIZING A SHARED SERVICES AGREEMENT BY AND BETWEEN THE COUNTY OF PASSAIC AND THE COUNTY OF MORRIS FOR SNOW REMOVAL ON OAK RIDGE ROAD IN THE TOWNSHIP OF WEST MILFORD, PURSUANT TO N.J.S.A. 40A:65-1, ET SEQ.

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the Uniform Shared Services and Consolidation Act, N.J.S.A. 40A:65-1, et seq. authorizes the County to enter into an agreement with any other local unit(s) to provide or receive any service that each local unit participating in the agreement is empowered to provide or receive within its own jurisdiction; and
WHEREAS, County Road 699 in the Passaic County is known as Oak Ridge Road in the Township of West Milford, spanning from New Jersey Route 23 to the Morris County/Jefferson Township Line; and
WHEREAS, County Road 699 in Morris County is known as Berkshire Valley Road in the Township of Jefferson, spanning from New Jersey Route 15 to the Passaic County/West Milford Township Line; and
WHEREAS, both Passaic and Morris counties are responsible for the maintenance, control, and snow removal of their respective portions of County Road 699; and
WHEREAS, Passaic and Morris counties desire to enter into a Shared Services Agreement, which is attached hereto and made part of this Resolution, whereby Morris County’s designated contractor for snow plowing and salting shall plow and salt Oak Ridge Road in the Township of West Milford, and Passaic County shall reimburse Morris County for the costs associated with same; and
WHEREAS, the above-described Shared Services Agreement shall commence on October 1, 2026, and expire on May 1, 2027, with two one-year options to renew upon the mutual agreement of both parties, in accordance with the terms and conditions set forth in the Shared Services Agreement; and
WHEREAS, this matter was discussed at the July 29, 2026, Administration & Finance Committee meeting, and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:65-1, et seq., the Board of County Commissioners of the County of Passaic authorizes the attached Shared Services Agreement by and between the County of Passaic and the County of Morris, whereby Morris County’s designated contractor for snow plowing and salting shall plow and salt Oak Ridge Road in the Township of West Milford, and Passaic County shall reimburse Morris County for the costs associated with same, for a term commencing on October 1, 2026 and expiring on May 1, 2027, with two one-year options to renew upon the mutual agreement of both parties, in accordance with the terms and conditions set forth in the attached Shared Services Agreement.
LET IT BE FURTHER RESOLVED, that pursuant to N.J.S.A. 40A:65-4(b), this Agreement shall be filed, for informational purposes, with the Division of Local Government Services in the Department of Community Affairs.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, County Administrator, and Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
