RESOLUTION AUTHORIZING COMPETITIVE CONTRACTING FOR PHONE SERVICES AND DEDICATED INTERNET SERVICES FOR THE COUNTY OF PASSAIC, PURSUANT TO N.J.S.A. 40A:11-4.1(i)

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the County is desirous of soliciting proposals from qualified vendors to provide phone services and dedicated internet services to the County; and
WHEREAS, N.J.S.A. 40A:11-4.1, et seq. authorizes the County to utilize competitive contracting in lieu of public bidding for procurement of specialized goods and services, the price of which exceeds the bid threshold; and
WHEREAS, N.J.S.A. 40A:11-4.1(i) specifically authorizes the County to utilize competitive contracting for the procurement of any good or service that is exempt from bidding under N.J.S.A. 40A:11-5; and
WHEREAS, pursuant to N.J.S.A. 40A:11-5(f), the supplying of any product or the rendering of any service by a public utility, which is subject to the jurisdiction of the Board of Public Utilities or the Federal Energy Regulatory Commission or its successor, is exempt from public bidding; and
WHEREAS, N.J.S.A. 40A:11-4.3 requires the County to pass a resolution authorizing the use of competitive contracting each time specialized goods or services enumerated under N.J.S.A. 40A:11-4.1 are contracted for; and
WHEREAS, the Passaic County Purchasing Agent is requesting authorization to initiate competitive contracting for (1) phone services and (2) dedicated internet services; and
WHEREAS, this matter was discussed at the February 14, 2024 Administration and Finance Committee meeting, and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4.1(i), the Board of County Commissioners of the County of Passaic authorizes competitive contracting for (1) phone services and (2) dedicated internet services for the County of Passaic.
LET IT BE FURTHER RESOLVED, that the Passaic County Purchasing Agent is hereby authorized and directed to initiate the competitive contracting process, in compliance with N.J.S.A. 40A:11-4.1, et seq., as follows:
1. Initiate the competitive contracting process for phone services.
2. Initiate the competitive contracting process for dedicated internet services.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, County Administrator, Purchasing Agent and Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
