RESOLUTION AUTHORIZING THE COUNTY OF PASSAIC TO ENTER INTO AN AGREEMENT GRANTING SAINT-GOBAIN PERFORMANCE PLASTICS CORPORATION ACCESS TO THE PREAKNESS VALLEY GOLF COURSE FOR THE INSTALLATION OF A MONITORING WELL, PURSUANT N.J.S.A. 40:20-1, ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereafter “Board”) is vested with decision making powers on behalf of the County; and
WHEREAS, the County of Passaic owns and operates the Preakness Valley Golf Course located at 209 Totowa Road, Wayne, New Jersey 07470; and
WHEREAS, the installation of one (1) monitoring well is required on Preakness Valley Golf Course, Parish Drive (Block 604, Lot 11) to delineate certain compounds in groundwater; and
WHEREAS, Forensic Environmental Services, Inc., (“FES”) on behalf of Saint-Gobain Performance Plastics (“SGPPL”) is currently conducting remedial investigation activities at the Saint-Gobain Plastics site and has determined the optimal location for the proposed monitoring well; and
WHEREAS, the County Engineer is recommending that the County enter into an agreement (hereafter “Access Agreement”) with Saint-Gobain Performance Plastics Corporation for the installation of the monitoring well; and
WHEREAS, the terms and conditions of the Access Agreement, attached herein, have been reviewed and found to be in the best interest of the County; and
WHEREAS, this matter was discussed at the May 14, 2025, meeting of the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-23, et seq., that the Passaic County Board of Commissioners hereby authorizes the execution of an agreement granting Saint-Gobain Performance Plastics Corporation access to the Preakness Valley Golf Course to install a monitoring well to delineate certain compounds in groundwater.
LET IT BE FURTHER RESOLVED, that the Director of the Board of County Commissioners, the Clerk to the Board, and County Counsel are authorized to execute the agreement and take any other steps necessary to carry out the purpose of this resolution
