RESOLUTION RENEWING THE PASSAIC COUNTY ENERGY REGIONAL COOPERATIVE PRICING SYSTEM (203PCERCPS) FOR A FIVE-YEAR TERM, FROM NOVEMBER 1, 2026, TO OCTOBER 31, 2031, PURSUANT TO N.J.A.C. 5:34-7.5, ET SEQ.

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-10, et seq., the governing bodies of two or more contracting units may provide by joint agreement for the provision and performance of goods and services for use by their respective jurisdictions; and
WHEREAS, on July 19, 2011, the Board approved Resolution No. R11501, authorizing the County to create a cooperative purchasing system for the purpose of procuring the bulk purchase of energy as a commodity, to be known as the Passaic County Energy Regional Cooperative Pricing System (ID #203PCERCPS), and for the County to both participate in and serve as the lead agency for said cooperative purchasing system; and
WHEREAS, pursuant to N.J.A.C. 5:34-7.5(f), approval of a cooperative purchasing system shall be for a period not to exceed five years, and shall be limited to the terms, conditions, and scope of services presented for approval, with any subsequent changes submitted to the Director of the Division of Local Government Services on Form CP-2001; and
WHEREAS, on August 11, 2015, the Board approved Resolution No. R20150506, renewing the Passaic County Energy Regional Cooperative Pricing System for a five-year term expiring on October 31, 2021; and
WHEREAS, on September 8, 2021, the Board approved Resolution No. R20210796, retroactively renewing the Passaic County Energy Regional Cooperative Pricing System for a five-year term expiring on October 31, 2026; and
WHEREAS, the County Purchasing Agent is recommending that the Passaic County Energy Regional Cooperative Pricing System be renewed for an additional five-year term, effective November 1, 2026, and expiring on October 31, 2031; and
WHEREAS, this matter was discussed at the July 1, 2026, Administration and Finance Committee meeting, and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.A.C. 5:34-7.5, the Board of County Commissioners of the County of Passaic hereby authorizes the renewal of the Passaic County Energy Regional Cooperative Pricing System (ID #203PCERCPS) for a five-year term, effective November 1, 2026 and expiring on October 31, 2031.
LET IT BE FURTHER RESOLVED, that the County Purchasing Agent is authorized to take all necessary action to renew the Passaic County Energy Regional Cooperative Pricing System, including, but not limited to, submitting a completed Form CP-2001 to the Director of the Division of Local Government Services.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, Purchasing Agent, and Director of the Board are authorized to take any other action necessary to carry out the purpose of this Resolution.
