RESOLUTION AUTHORIZING THE COUNTY TO GRANT AN EASEMENT TO THE BOROUGH OF POMPTON LAKES ON A PORTION OF BLOCK 2300, LOTS 1, 7, AND 10 IN THE BOROUGH OF POMPTON LAKES, FOR THE OPERATION OF THE POMPTON LAKES RECYCLING CENTER, PURSUANT TO N.J.S.A. 40A:12-13.3

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the County is the owner in fee of certain property located within the Borough of Pompton Lakes at Block 2300, Lots 1, 7, and 10 as shown on the Official Tax Map of the Borough of Pompton Lakes, bounded to the north by Ivy Street, to the west by Laura Street, and to the East by Grove Street; and
WHEREAS, the Borough of Pompton Lakes operates a recycling facility known as the Pompton Lakes Recycling Center on a portion of the above-referenced properties; and
WHEREAS, the County is constructing a salt storage facility and associated site improvements for the storage of rock salt on a separate portion of the above-referenced properties; and
WHEREAS, as authorized by Resolution R20211191 dated December 28, 2021, and Resolution No. R-23-0608 dated June 27, 2023, the County is in the process of selling real property located at 519 Ringwood Avenue (Block 2600, Lot 2) in the Borough of Pompton Lakes to the Passaic County Affordable Housing Corporation, and upon such property is situated a small portion of the Pompton Lakes Recycling Center; and
WHEREAS, during the process of selling 519 Ringwood Avenue, and constructing the above-referenced rock salt storage facility, the County desires to delineate a portion of Block 2300, Lots 1, 7, and 10 for exclusive use by the Borough of Pompton Lakes for the Pompton Lakes Recycling Center; and
WHEREAS, pursuant to N.J.S.A. 40A:12-13.3, the County may transfer any property interest not needed for County purposes to a municipality within the County by resolution, and for nominal consideration, provided that such property shall be used for public purposes; and
WHEREAS, the County desires to formally grant an easement to the Borough of Pompton Lakes for the operation of the Pompton Lakes Recycling Facility pursuant to the Deed of Easement, attached hereto and made part hereof; and
WHEREAS, this matter was discussed at the February 14, 2024 meeting of the Public Works Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:12-13.3, that the Board of County Commissioners of the County of Passaic hereby grants an easement to the Borough of Pompton Lakes for the operation of the Pompton Lakes Recycling Center, on certain portions of County-owned property at Block 2300, Lots 1, 7, and 10 in the Borough of Pompton Lakes, as delineated in the Deed of Easement, attached hereto and made part hereof.
LET IT BE FURTHER RESOLVED, the Director of the Board of County Commissioners, Clerk of the Board and County Counsel are hereby authorized to execute a Deed of Easement on behalf of Passaic County.
