RESOLUTION AUTHORIZING COMPETITIVE CONTRACTING TO AWARD CONTRACTS UNDER THE DEPARTMENT OF SENIOR SERVICES AREA PLAN CONTRACT FOR THE 2025-2027 GRANT PERIOD, PURSUANT TO N.J.S.A. 40A:11-4.1(b)(2).

WHEREAS, the County of Passaic (hereinafter the “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1 et.seq., and vested with the rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, et.seq., the Board of County Commissioners for the County of Passaic (hereinafter the “Board”) are vested with the decision-making powers on behalf of the County; and
WHEREAS, the County, through its Senior Services Department (hereafter “Department”), provides assistance with senior benefit programs, including home and community services to senior citizens throughout Passaic County; and
WHEREAS, N.J.S.A. 40A:11-4.1, et.seq., authorizes the County to utilize competitive contracting in lieu of public bidding for procurement of specialized goods and services, the price of which exceeds the bid threshold; and
WHEREAS, N.J.S.A. 40A:11-4.1(b)(2) specifically allows the County to use competitive contracting for any service related to the operation, management or administration of social services programs; and
WHEREAS, N.J.S.A. 40A:11-4.3 requires that the County pass a resolution authorizing the use of competitive contracting each time specialized goods and services enumerated in Section 1 of P.L. 1999, c.440 (C.40A:11-4.1) are desired to be contracted; and
WHEREAS, the Department desires to identify service providers who specialize in providing access, home support services, community support services, and nutrition services for County residents ages sixty (60) years or older (hereafter “Area Plan Contract”); and
WHEREAS, this matter was discussed at the June 4, 2024, meeting of the Health and Human Services Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4.1(b)(2), the Board of County Commissioners of the County of Passaic (hereafter “Board”) is authorizing competitive contracting to retain service providers who specialize in providing access, home support services, community support services, and nutrition services for County residents ages sixty (60) years or older, for the Department of Senior Services; and
LET IT BE FURTHER RESOLVED, that the Passaic County Purchasing Agent is authorized to take all necessary action to carry out the purpose of this Resolution and initiate the competitive contracting process in compliance with N.J.S.A. 40A:11-1, et.seq., including all noticing and advertising requirements therein; and
LET IT BE FURTHER RESOLVED, that the County Administrator, County Counsel, Clerk of the Board, and Chief Financial Officer for the County of Passaic are authorized to take all necessary action to carry out the purpose of this Resolution.
