RESOLUTION AUTHORIZING A LEASE AGREEMENT BETWEEN THE COUNTY OF PASSAIC AND 400 HAMBURG TURNPIKE, LLC, TO RENT TWENTY (20) PARKING SPACES FOR THE USE OF PASSAIC COUNTY SHERIFF’S OFFICE VEHICLE OVERFLOW PARKING AT 400 HAMBURG TURNPIKE IN WAYNE PURSUANT TO N.J.S.A. 40A:12-4

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:12-4, the County may acquire any interest in any property with the consent of the property owner; and
WHEREAS, the Passaic County Sheriff’s Office seeks twenty (20) parking spaces for vehicle overflow for its fleet; and
WHEREAS, 400 Hamburg Turnpike, LLC, owns vacant real property located at 400 Hamburg Turnpike, Wayne, New Jersey 07470 across the street from the headquarters of the Passaic County Sheriff’s Office.
WHEREAS, the Passaic County Sheriff’s Office is recommending that the Board authorize enter into a lease agreement to rent twenty (20) parking spaces from 400 Hamburg Turnpike LLC for vehicle overflow parking at 400 Hamburg Turnpike in Wayne, New Jersey, in the amount of two thousand dollars ($2,000.00), per month, for an annual total of twenty-four thousand dollars ($24,000.00) for the period beginning of January 1, 2026, and ending on December 31, 2026, contingent on the 2026 budget; and
WHEREAS, funds are available in Account No.: 6-01-22-130-002-213, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in 2026 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:12-4, that the Board of County Commissioners of the County of Passaic authorizes the execution of the lease agreement between with 400 Hamburg Turnpike, LLC, which is attached and made a part of this Resolution, in the amount of two thousand dollars ($2,000.00), per month, for an annual total of twenty-four thousand dollars ($24,000.00) for the period beginning of January 1, 2026, and ending on December 31, 2026.
LET IT BE FURTHER RESOLVED that the Clerk to the Board, County Administrator, County Counsel, and the Director of the Board are authorized to take any other steps necessary to carry out the purpose of this Resolution, including executing a lease agreement in connection with the terms of this Resolution.
