RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO THE FIREWOOD FARM, INC. AND DTS TRUCKING, LLC, TO PROVIDE MULCH PRODUCTS FOR THE DEPARTMENT OF PARKS AND RECREATION, SB-25-026, PURSUANT TO N.J.S.A 40A:11-4 ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Passaic Board of County Commissioners (hereafter “Board”) is vested with decision making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., for every contract awarded by the County for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold established pursuant to N.J.S.A. 40A:11-3, shall be awarded by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, on December 26, 2024, the Purchasing Agent issued Mulch Products for the County of Passaic Parks and Recreation Department, SB-25-026 (hereafter “SB-25-026”), in compliance with N.J.S.A. 40A:11-4, et seq., seeking a vendor to provide mulch products to the County; and
WHEREAS, the lowest responsible bidders to SB-25-026 are The Firewood Farm, Inc., as to Item 1, Certified Playground Mulch, and DTS Trucking, LLC, as to Item 2, Double Ground Brown Mulch; and
WHEREAS, the Director of Parks & Recreation is recommending that the Board authorize an award of contract to The Firewood Farm, Inc. and DTS Trucking, LLC, for mulch products under SB-25-026, beginning May 1, 2025 and expiring April 30, 2026, with one (1) one-year option to renew;
WHEREAS, the Director of Parks & Recreation further desires to appropriate an amount not to exceed twenty-seven thousand five hundred dollars ($27,500.00) for purchases under SB-25-026; and
WHEREAS, funds are available in Account No. O-25-56-635-002-608 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent years’ County budget (s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the February 12, 2024 meeting of the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4, that the Board of County Commissioners of the County of Passaic authorizes the award of contract to The Firewood Farm, Inc. and DTS Trucking, LLC, for mulch products under SB-25-026, beginning May 1, 2025 and expiring April 30, 2026, with one (1) one-year option to renew.
LET IT BE FURTHER RESOLVED, that the Board authorizes the appropriation of an amount not to exceed twenty-seven thousand five hundred dollars ($27,500.00) for purchases under SB-25-026.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, and Director of the Board are authorized to execute the contracts and take any other steps necessary to carry out the purpose of this resolution.
