RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO COLLEGE ACHIEVE PATERSON CHARTER SCHOOL, INC. TO PROVIDE YOUTH EMPOWERMENT AND WELLNESS PROGRAM SERVICES TO HIGH SCHOOL STUDENTS IN THE COUNTY OF PASSAIC, PURSUANT TO RFP-25-020 AND N.J.S.A. 40A:11-4.1, ET SEQ.

WHEREAS, the County of Passaic (the “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereinafter the “Board”) are vested with decision-making powers on behalf of the County; and
WHEREAS, the Department of Human Services (hereafter “Department”) is an umbrella social service agency concerned with planning and funding services for disadvantaged and homeless citizens; and
WHEREAS, N.J.S.A. 40A:11-4.1 authorizes the County to utilize competitive contracting in lieu of public bidding for procurement of specialized goods and services, the price of which exceeds the bid threshold; and
WHEREAS, N.J.S.A. 40A:11-4.1(b)(2) specifically authorizes the County to utilize competitive contracting to procure services related to the operation, management or administration of social service programs, under which this program falls; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4.3, the Board approved Resolution R-23-0876, dated September 26, 2023, authorizing the Department to initiate the RFP process to procure social services to youth involved with, at risk of involvement with, and re-entering from involvement with the juvenile justice system; and
WHEREAS, on March 17, 2025, the Purchasing Agent issued RFP-25-020: Re-Bid Youth Services Plan Grant Administered by the County Department of Human Services (hereafter “RFP-25-020”), responses to which were unsealed on April 8, 2025; and
WHEREAS, in accordance with the law, a Review Committee was convened to review the responses to RFP-25-020, and issued a memorandum, attached to and made part of this Resolution, recommending an award of contract to College Achieve Paterson Charter School, Inc. to provide its Colt Street Cares Program to high school students in the County, from April 1, 2025 to December 31, 2025, for a total amount not to exceed fifty-two thousand five hundred dollars ($52,500.00), with the County retaining four (4) one (1) year options to be exercised at the discretion of the Board; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.4, this contract is being awarded pursuant to a fair and open process, specifically, the request for proposals for the projects under RFP-25-020 was publicly advertised, awarded under a process that provides for public solicitation of qualifications, established the basis of an award and disclosure process documented in writing prior to any solicitation, and is publicly opened and announced when awarded; and
WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et seq., College Achieve Paterson Charter School, Inc. executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying that it is not involved in prohibited activities in Russia and Belarus, and the County confirmed said vendor is not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, funds are available in Account No. G-01-41-810-025-213 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the April 15, 2025 meeting of the Health and Human Services Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4.1, et seq., the Board of County Commissioners of the County of Passaic (hereafter “Board”) is authorizing contract award to College Achieve Paterson Charter School, Inc. to provide its Colt Street Cares Program to high school students in the County, from April 1, 2025 to December 31, 2025, for a total amount not to exceed fifty-two thousand five hundred dollars ($52,500.00), with the County retaining four (4) one (1) year options to be exercised at the discretion of the Board.
LET IT BE FURTHER RESOLVED, the Clerk to the Board shall print, in the official newspaper, a brief notice stating the nature, duration, service, and amount of the contract to College Achieve Paterson Charter School, Inc., and maintain a copy of the Resolution on file and available for public inspection in the Office of the Clerk to the Board.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, Director of the Board, and County Counsel are authorized to take any other steps necessary to carry out the purpose of this Resolution.
