RESOLUTION REJECTING ALL BIDS RECEIVED FOR 495 RIVER STREET - HVAC AND ROOF REPLACEMENT PROJECT IN THE CITY OF PATERSON, PER BID C-26-008, PURSUANT TO N.J.S.A. 40A:11-13.2 (d), ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereafter “Board”) is vested with decision making powers on behalf of the County; and
WHEREAS, on February 24, 2026, the Purchasing Agent issued Bid No. C-26-008, 495 River Street - HVAC and Roof Replacement (hereafter “C-26-008”) seeking sealed proposals from qualified bidders to perform various improvements to the roof and HVAC facilities at the County building located at 495 River Street in the City of Paterson; and
WHEREAS, on March 17, 2026, the Purchasing Agent unsealed responses to C-26-008; and
WHEREAS, pursuant to N.J.S.A. 40A:11-13.2(d) the Board may reject all bids wherein the contracting unit must substantially revise the specifications for the goods and services; and
WHEREAS, Passaic County Engineer wishes to substantially revise the specifications for the project bid under C-26-008, and is recommending that the bids be rejected in accordance with the law; and
WHEREAS, this matter was discussed on March 23, 2026 by the Public Works Committee, and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A 40A:11-13.2(d) that the Board of County Commissioners of the County of Passaic rejects all the bids received under C-26-008, 495 River Street - HVAC and Roof Replacement, as recommended by the Passaic County Engineer.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, Director of the Board of County Commissioners, County Engineer, and Purchasing Agent are authorized to take any other steps necessary to carry out the purpose of this Resolution.
