RESOLUTION AUTHORIZING THE INVOLUNTARY RETIREMENT OF CARLOS DELA CRUZ, PURSUANT TO N.J.S.A. 40:20-1

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, to submit an application for Involuntary Disability Retirement, the New Jersey Department of Pensions and Benefits requires local employers to adopt a resolution by the governing body stating that, in the employing authority’s opinion, the employee is totally and permanently disabled from fulfilling his or her job duties; and
WHEREAS, the Director of Human Resources has determined that Carlos Dela Cruz has been totally and permanently disabled from fulfilling his job duties as a Sheriff’s Officer since April 18, 2025, and is seeking authorization from the Board to apply for the involuntary retirement of Mr. Dela Cruz to the New Jersey Department of Pensions and Benefits; and
WHEREAS, this matter was discussed at the August 26, 2026, Administration and Finance Committee meeting, and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic authorizes an application for the involuntary retirement of Carlos Dela Cruz to the State of New Jersey, Department of Pensions and Benefits as Mr. Dela Cruz has been totally and permanently disabled from fulfilling his job duties as a Sheriff’s Officer since April 18, 2025.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, Director of Human Resources, and Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
