RESOLUTION AUTHORIZING THE PURCHASE OF ONE (1) KUBOTA UTILITY VEHICLE FROM CHERRY VALLEY TRACTOR SALES, PURSUANT TO N.J.S.A. 40A:11-10

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-10, the governing bodies of two or more contracting units may provide by a joint agreement for the provision of the performance of goods and services to be used by their respective jurisdictions; and
WHEREAS, the County is a member of the Educational Services Commission of New Jersey, which awarded a contract for Grounds Equipment, Contract #ESCNJ 22/23-12 to Cherry Valley Tractor Sales, to provide grounds equipment to members of the cooperative; and
WHEREAS, Cherry Valley Tractor Sales, provided a quote for one (1) Kubota Utility Vehicle to the Supervisor of Roads, in an amount not to exceed twenty-five thousand two hundred eighty-nine dollars and forty-seven cents ($25,289.47), attached to and made part of this resolution, which is being recommended for approval by the Supervisor of Roads; and
WHEREAS, funds are available in Account No. T-20-56-880-024-801, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the November 25, 2024, Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-10, the Board of County Commissioners of the County of Passaic is authorizing the purchase of one (1) Kubota Utility Vehicle from Cherry Valley Tractor Sales, in an amount not to exceed twenty-five thousand two hundred eighty-nine dollars and forty-seven cents ($25,289.47), as recommended by the Supervisor of Roads.
LET IT BE FURTHER RESOLVED, that the Director of the Board of County Commissioners, the Clerk to the Board, County Counsel, and Purchasing Agent are authorized to execute an agreement and take any other steps necessary to carry out the purpose of this resolution.
