RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO AURORA ENVIRONMENTAL, INC., FOR THE COUNTY’S UNDERGROUND STORAGE TANKS (UST) AND ABOVE GROUND STORAGE TANKS (AST) MONTHLY INSPECTIONS AND ANNUAL TESTING FOR THE YEAR 2026, PER BID SB-25-004 PURSUANT TO N.J.S.A. 40A: 11-4, ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., every contract awarded by the County, for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold [40A:11-3], shall be awarded only by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, on October 3, 2024, the Purchasing Agent issued SB-25-004, On-Call Services for Underground Storage Tanks (UST) and Above Ground Storage Tanks (AST) (hereafter “SB-25-004”) seeking sealed proposals from qualified bidders for On-Call Services for Underground Storage Tanks and Above Ground Storage Tanks; and
WHEREAS, on November 18, 2024, the Board passed Resolution No. R-24-1056, establishing unit prices and qualifying respondents to be used on an as needed basis under SB-25-004 for a period of two years, beginning January 1, 2025 through December 31, 2026, with Aurora Environmental and T. Slack Environmental offering their unit prices to the County; and
WHEREAS, the Passaic County Engineer is recommending an award of contract to Aurora Environmental, Inc. for monthly inspections and annual testing of the County’s USTs and ASTs for the year 2026 in an amount not to exceed thirty-seven thousand one hundred twenty-eight dollars ($37,128.00); and
WHEREAS, funds are available in Account No. 6-01-31-220-001-219 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2026 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the March 11, 2026 meeting of the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-12, et seq. that the Board of County Commissioners of the County of Passaic authorizes an award of contract to Aurora Environmental, Inc., for monthly inspections and annual testing for the year 2026 in an amount not to exceed thirty-seven thousand one hundred twenty-eight dollars ($37,128.00), as recommended by the County Engineer.
LET IT BE FURTHER RESOLVED, that the Purchasing Agent, Clerk of the Board, and County Counsel are hereby authorized and directed to take such further actions and sign such documents as are necessary to effectuate the purpose of this Resolution, including but not limited to the issuance of the appropriate Purchase Order.
