RESOLUTION AUTHORIZING ACCEPTANCE, FINAL PAYMENT AND PROJECT CLOSE OUT TO CLARKE MOYNIHAN LANDSCAPING & CONSTRUCTION, LLC, FOR THE DEY MANSION GARDEN RESTORATION PHASE II: KITCHEN GARDEN PROJECT, PER BID C-24-015, PURSUANT TO N.J.S.A. 40A:11-16.3(b) ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-16.3(b), et seq., the Board can authorize release of final payment upon acceptance of the work performed pursuant to the contract provided that the contract has been completed; and
WHEREAS, on October 4, 2024, the Purchasing Agent issued Dey Mansion Garden Restoration Phase II: Kitchen Garden, C-24-015 (hereafter “C-24-015”) seeking sealed proposals from qualified bidders to rehabilitate the garden and install a kitchen garden at Dey Mansion in the Township of Wayne; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., on November 18, 2024, the Board passed Resolution No. R-24-1036, authorizing an award of contract under C-24-015 to the lowest responsible bidder, Clarke Moynihan Landscaping & Construction, LLC, in an amount not to exceed two hundred sixty-eight thousand eight hundred sixty-five dollars ($268,865.00); and
WHEREAS, the Passaic County Department of Cultural & Historic Affairs is advising that the Project is complete and conforms to the approved scope, and is also requesting that the Board approve the Project’s close out, final acceptance, release of retainage, and final payment to Clarke Moynihan Landscaping & Construction, LLC, in the amount of thirty-seven thousand three hundred five dollars and twelve cents ($37,305.12); and
WHEREAS, funds are available in Account No. O-23-56-651-000-604, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2026 and/or subsequent years’ County budget(s); and
WHEREAS, this matter was discussed at the March 11, 2026 meeting of the Public Works Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-16.3(b) et seq., the Board of County Commissioners of the County of Passaic hereby authorizes and approves project close out, final acceptance, release of retainage, and final payment to Clarke Moynihan Landscaping & Construction, LLC, in the amount of thirty-seven thousand three hundred five dollars and twelve cents ($37,305.12) for the Dey Mansion Garden Restoration Phase II: Kitchen Garden project, and the Director of Finance is hereby authorized to make payment to said company on the next bill list.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, Director of the Department of Cultural & Historic Affairs, and Director of the Board of County Commissioners are authorized to execute any documents and forms necessary, and take any other action necessary to carry out the purpose of this Resolution.
