RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO NEW DESTINY FAMILY SUCCESS CENTERS, INC. TO PROVIDE A RESTORATIVE AND TRANSFORMATIVE JUSTICE HUB, PURSUANT TO N.J.S.A. 40A:11-4.1, ET SEQ. AND RFP-26-024

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, N.J.S.A. 40A:11-4.1 authorizes the County to utilize competitive contracting in lieu of public bidding for procurement of specialized goods and services, the price of which exceeds the bid threshold; and
WHEREAS, N.J.S.A. 40A:11-4.1(b)(2) specifically allows the County to use competitive contracting for the operation, management, or administration of recreation or social service facilities or programs; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4.3, on July 19, 2022, the Board passed Resolution No. R-22-0663, authorizing the use of competitive contracting for the procurement of youth and community transformative justice program services; and
WHEREAS, on June 9, 2026, the Purchasing Agent issued RFP-26-024, Restorative and Transformative Justice for Youth and Communities Grant Administered by the County Department of Human Services (“RFP-26-024”), responses to which were unsealed on June 30, 2026; and
WHEREAS, in accordance with the law, a review committee was convened to review and score the responses to RFP-26-024, and as set forth in the attached memorandum, which is made a part of this Resolution, recommended a contract award to New Destiny Family Success Centers, Inc. to provide a Restorative and Transformative Justice Hub in the City of Paterson serving youths and their families, for a contract term commencing upon award and expiring on December 31, 2026, and a total amount not to exceed two hundred thirty-three thousand seven hundred and fifty dollars ($233,750.00) during such term, with the County retaining four (4) one-year options to renew, contingent on availability of funds and satisfactory performance; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.4, this contract is being awarded under a fair and open procurement process, which requires that a contract be: publicly advertised in sufficient time to give notice in advance of the contract; awarded under a process that provides for public solicitation of proposals or qualifications; awarded and disclosed under criteria established in writing by the public entity prior to the solicitation of proposals or qualifications; and publicly opened and announced when awarded; and
WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et seq., New Destiny Family Success Centers, Inc. executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying that it is not involved in prohibited activities in Russia and Belarus, and the County confirmed that said vendor is not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, funds are available in Account No. G-01-41-824-022-213, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2026 and/or subsequent County budget(s), which is attached hereto and made part of this Resolution; and
WHEREAS, this matter was presented for the July 1, 2026, Health & Human Services Committee meeting, and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4.1, et seq., the Board of County Commissioners of the County of Passaic authorizes a contract award to New Destiny Family Success Centers, Inc. to provide a Restorative and Transformative Justice Hub in the City of Paterson serving youths and their families, for a contract term commencing upon award and expiring on December 31, 2026, and a total amount not to exceed two hundred thirty-three thousand seven hundred and fifty dollars ($233,750.00) during such term, with the County retaining four (4) one-year options to renew, contingent on availability of funds and satisfactory performance, all in accordance with RFP-26-024 and the provider’s response thereto.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board shall print, in the official newspaper, a brief notice stating the nature, duration, service, and amount of the contract awarded to New Destiny Family Success Centers, Inc. and maintain a copy of this Resolution on file and available for public inspection in the Office of the Clerk to the Board.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, Purchasing Agent, Director of the Department, and Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
