RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO MAGIC TOUCH CONSTRUCTION CO., INC., FOR GREASE TRAP PUMPING/CLEANING AND JETTING OF FLOOR DRAINS FOR PREAKNESS HEALTHCARE CENTER IN THE TOWNSHIP OF WAYNE, PURSUANT TO N.J.S.A. 40A:11-4.

WHEREAS, the County of Passaic (the “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereinafter the “Board”) are vested with decision making powers on behalf of the County; and
WHEREAS, the Superintendent of Buildings & Grounds is in need of a contractor to perform pumping and cleaning of grease traps and jetting and cleaning of floor drains at the Preakness Healthcare Center located at 305 Oldham Road, in the Township of Wayne; and
WHEREAS, on November 27, 2024, the Purchasing Agent issued SB-25-018 Grease Trap Pumping/Cleaning and Jetting of Floor Drains for Preakness Healthcare Center 305 Oldham Road Wayne NJ, Bid No. SB-25-018 (hereafter “SB-25-018”) seeking sealed proposals from qualified bidders, to be used on an as-needed basis; and
WHEREAS, on December 11, 2024, bids were unsealed for SB-25-018 by the Purchasing Agent with three (3) responses from qualified bidder, including Magic Touch Construction Co., Inc.; and
WHEREAS, the lowest responsible bidder to SB-25-018 is Magic Touch Construction Co., Inc.; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, the Superintendent of Buildings & Grounds is recommending that the Board authorize an award of contract to Magic Touch Construction Co., Inc. to perform pumping and cleaning of grease traps and jetting and cleaning of floor drains at the Preakness Healthcare Center located at 305 Oldham Road, in the Township of Wayne, for a two (2) year term beginning March 1, 2025 through February 28, 2027 in an amount not to exceed twenty-five thousand dollars ($25,000.00) per year with a total award amount not to exceed fifty thousand dollars ($50,000.00); and
WHEREAS, funds are available in Account No. 5-01-20-112-004-213 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the January 15, 2025 meeting of the Public Works Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-10, the Board of County Commissioners of the County of Passaic is authorizing an award of contract to Magic Touch Construction Co., Inc., to perform pumping and cleaning of grease traps and jetting and cleaning of floor drains at the Preakness Healthcare Center located at 305 Oldham Road, in the Township of Wayne, for a two (2) year term beginning March 1, 2025 through February 28, 2027 in an amount not to exceed twenty-five thousand dollars ($25,000.00) per year with a total award amount not to exceed fifty thousand dollars ($50,000.00).
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, and Director of the Board of County Commissioners of the County of Passaic are authorized to execute an agreement and take any other steps necessary to carry out the purpose of this resolution.
