RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO T. SLACK ENVIRONMENTAL SERVICES, INC., FOR ON-CALL SERVICES FOR UNDERGROUND STORAGE TANKS (UST) AND ABOVE GROUND STORAGE TANKS (AST) MONTHLY INSPECTIONS AND ANNUAL TESTING FOR THE YEAR 2024, PURSUANT TO N.J.S.A. 40A: 11-1, ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40:11-4, et seq., every contract awarded by the County, for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold [40A:11-3], shall be awarded only by resolution of the Board to the lowest responsible bidder after public advertising for bid and bidding thereof; and
WHEREAS, on October 24, 2022, the County’s Purchasing Agent issued SB-23-009 establishing a pool of qualified vendors for On-Call Underground Storage Tanks (“UST”) and Above Storage Tanks (“AST”) companies with set unit prices for a two-year period beginning January 1, 2023, and expiring on December 31, 2024 (“SB-23-009”), seeking sealed proposal from qualified bidders for on-call services for UST and AST; and
WHEREAS, to promote competitive bidding, SB-23-009 was advertised in the County’s official newspaper prior to the date fixed for receiving the bids in accordance with N.J.S.A. 40A:11-23; and
WHEREAS, on December 13, 2022, the Board passed Resolution R-22-1155 qualifying a pool of testing companies and establishing unit prices for on-call service for UST and AST on an as-needed basis for a two-year period beginning January 1, 2023, and expiring on December 31, 2024, which included T. Slack Environmental; and
WHEREAS, the Passaic County Engineer is recommending that the Board award a contract to T. Slack Environmental for on-call services for UST and AST monthly inspections and annual testing for the year 2024 in an amount not to exceed thirty-nine thousand fifty dollars ($39, 050.00); and
WHEREAS, funds are available in Account No. C-04-31-220-001-219 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, T. Slack Environmental has agreed to provide the goods and services herein to registered members in the Passaic County Cooperative Pricing System #38-PCCP subject to the overall terms of the contract awarded by the County of Passaic; and
WHEREAS, this matter was discussed at the February 14, 2024 meeting of the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-1, et seq. the Board of County Commissioners of the County of Passaic authorizes an award of contract to T. Slack Environmental, for on-call services for UST and AST monthly inspections and annual testing for the year 2024 in an amount not to exceed thirty-nine thousand fifty dollars ($39, 050.00), as recommended by the County Engineer.
LET IT BE FURTHER RESOLVED, that the Purchasing Agent, Clerk of the Board, and County Counsel are hereby authorized and directed to take such further actions and sign such documents as are necessary to effectuate the purpose of this Resolution, including but not limited to the issuance of the appropriate Purchase Order.
