RESOLUTION AUTHORIZING A HOLD HARMLESS AGREEMENT BETWEEN THE COUNTY OF PASSAIC AND JOSEPH SCURALLI FOR PROPERTY LOCATED AT 31 KIEVIT ROAD, BLOCK 2205, LOTS 102 AND 102.1.

WHEREAS, the Passaic County Department of Planning and Economic Development is in receipt of a proposed Agreement (attached hereto) by and between the County of Passaic (hereafter “County”) and Joseph Scuralli (hereafter “Applicant”) regarding waiver of responsibility for any and all stormwater, silt or debris that enters Applicant’s property from the County right-of-way; and
WHEREAS, Applicant applied to the Passaic County Planning Board (hereinafter “Board”) under File No. SU-25-011 for minor subdivision approval to subdivide real property on a Passaic County roadway located at 1134 Ratzer Road, Wayne, New Jersey, Block 2205, Lots 102 & 102.1 (hereinafter the “Property”).
WHEREAS, on April 2, 2026, in lieu of requiring modifications to the driveway, the Passaic County Development Review Committee (hereinafter the “Committee”) required the Applicant to enter into an agreement, by review letter attached hereto, to protect and hold the County harmless for any and all damage caused to Applicant's Property in connection with any stormwater, silt, or debris that enters the Applicant's Property from the County right-of -way; and; and
WHEREAS, the Board has agreed to the plans as contained in the Minor Subdivision/Simple Lot Line Adjustment - Accessory Structure Site Plan for Scuralli, originally dated March 4, 2025, revised on January 6, 2026 ("Site Plan"), prepared by Darmstatter, Inc. on the Applicant’s agreement to protect and hold the County harmless and enter into an Agreement indemnifying the County for any claims or damages to the Applicant’s Property related to stormwater, silt, or debris that enters the property from the County right-of-way; and
WHEREAS, this matter was discussed at the May 14, 2026, meeting of the Planning and Economic Development Committee and is being recommended to the Passaic County Board of County Commissioners for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, by the Passaic County Board of County Commissioners that the County Commissioner Director and Clerk of the Board be and are hereby authorized to execute the attached Agreement by and between the County of Passaic and Joseph Scuralli, as set forth above.
