RESOLUTION AUTHORIZING THE RE-APPROPRIATION OF PASSAIC COUNTY OPEN SPACE TRUST FUND MONIES AWARDED TO THE BOROUGH OF BLOOMINGDALE FROM THE BOGUE POND PARK PHASE II IMPROVEMENTS PROJECT TO THE DELAZIER PARK PLAYGROUND RENOVATION PROJECT, PURSUANT TO N.J.S.A. 40:12-15.1 ET SEQ.

WHEREAS, the County of Passaic (hereafter "County") is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and

WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter "Board") is vested with managing the property, finances, and affairs of the County; and

WHEREAS the Board of County Commissioners of the County of Passaic (hereafter “Board”) created an Open Space, Farmland and Historic Preservation Trust Fund Program (hereafter “Program”) in conformity with the will of the voters in the 1996 election, as authorized by N.J.S.A. 40:12-15.2; and

WHEREAS the purpose and goals of the above is to achieve, in partnership with others, a system of interconnected open spaces, whose protection will preserve and enhance New Jersey’s natural environment and its historic, scenic, and recreational resources for public use and enjoyment; and

WHEREAS, pursuant to the mandates of the Program, the said Board did approve and appoint an Open Space, Farmland and Historic Preservation Trust Fund Advisory Committee (hereafter “the Committee”) to study the open space issue and make recommendations concerning the distribution of funds to worthy applicants; and

WHEREAS the Board previously awarded the Borough of Bloomingdale (hereafter "Borough") a Passaic County Open Space Trust Fund award in the amount of two hundred fifty thousand dollars ($250,000.00) in 2023 for the Bogue Pond Park Phase II Improvements Project (hereafter "Bogue Pond Project"); and

WHEREAS, the Bogue Pond Project has since been completed; and

WHEREAS, due to a donation received from a private donor, a balance of sixty thousand five hundred sixty-one dollars and seventy cents ($60,561.70) remains from the 2023 award for the Bogue Pond Project; and

WHEREAS, the Borough has requested that the remaining balance of sixty thousand five hundred sixty-one dollars and seventy cents ($60,561.70) be re-appropriated toward the Borough's ongoing renovation of the Delazier Park Playground (hereafter "Delazier Park Project"), which received a Passaic County Open Space Award in the amount of two hundred twenty-five thousand dollars ($225,000.00) in 2024; and

WHEREAS, the Borough reports that the Delazier Park Project has a current running total cost of three hundred thirty-five thousand four hundred eighty-three dollars and twenty-three cents ($335,483.23); and

WHEREAS, the re-appropriated funds would be applied toward the outstanding balance of the Delazier Park Project cost and would cover applicable Open Space items, including fencing and pathway paving work; and

WHEREAS, the Borough Administrator has submitted a letter to the County setting forth the details of the foregoing request; and

WHEREAS, the Board has determined that it is in the best interest of the County to authorize said re-appropriation.

NOW, THEREFORE, LET IT BE RESOLVED, for the reasons set forth above, the Board of County Commissioners of the County of Passaic hereby authorizes the Borough of Bloomingdale to reallocate their 2023 Open Space Trust Fund award in the amount of sixty thousand five hundred sixty-one dollars and seventy cents ($60,561.70) from the originally awarded Bogue Pond Park Phase II Improvements Project to the Delazier Park Playground renovation project; and

LET IT BE FURTHER RESOLVED, that the Clerk to the Board of County Commissioners, Director of the Board, County Counsel, and the Director of Planning are hereby authorized to execute the appropriate agreements in connection with the above.
